“She was attracted to me. It is, moreover, still “: The jury (Quebec Supreme Court, ed.) of Saône-et-Loire on Monday began the trial of a fifty-year-old who appears in the jury for the fourth time for the rape of a woman in 2012, which he continues to deny.
Abdelkrim Mouina, now 54, was sentenced in 2018 by the Doubs Assizes to eight years in prison for the rape of a woman on May 30, 2012 in Boussières, very close to Besançon.
The defendant appealed, but the Jura Circuit Court increased the sentence and sentenced him to 12 years in prison in October 2019.
Mouina then appealed to the Court of Cassation (equivalent to the Supreme Court, editor’s note) and had his conviction overturned in 2020 on the grounds that “the accused was unable to present his arguments”.
New jury trials, this time in Côte d’Or, increase her sentence again in June 2021, bringing her to fifteen years in prison.
But Mr Mouina challenged this judgment again and the Court of Cassation overturned it again and he is therefore being tried a fourth time, this time in Chalon-sur-Saône.
“I’m innocent, madam,” repeated the accused at the bar and turned to President Celine Therme.
“She could see very well that I was interested in her. She too was attracted to me. Incidentally, it’s still the case,” said the accused, who was released on August 24, 2022 after four years in custody.
Mr. Mouina, who has been in psychiatric care since 2002 and was sentenced to 10 years in prison for gang rape by the jury in 1986, only admits to stroking the victim’s clothes and rubbing them until he had an orgasm. There will be traces of his sperm on the dress.
The victim, she speaks of a digital and penile penetration that made her sink into depression and alcoholism. She was raped at the age of 16.
Mr. Mouina faces a 30-year prison sentence given his recidivism status.
The trial is expected to last until Wednesday.
