The family accused of the murder of Sergio BP, a 26-year-old man who died in a Madrid town in 2019 while trying to broker a fight, already know his verdict. The eldest son, Donizete C., has just been sentenced to 14 years in prison for manslaughter, while Sandra C., the mother accused of agitating, has been cleared of all responsibility. The youngest son, Alejandro L., received a four-year juvenile sentence in a youth home, which he is still serving today, while the father, Óscar L., committed suicide after his release from provisional custody before going to court. The murder occurred on a summer night in Ambite, a town in Madrid, when the victim, who had nothing to do with the brawl, suffered a stab wound in the heart.

Sergio only had three or four days left to finish his vacation and get back to work in the Technotronics sector. He spent his days in Ambite, his city, in a hurry, and the night he died he was with his friends on the rock near the Plaza Mayor. At around ten o’clock at night, Alejandro, the younger brother who had already been convicted, and other boys quarreled over an argument with another local girl. The anger escalated and Alejandro and his older brother Donizete went to their house a few meters away and quickly came down with a knife in each hand, accompanied by their parents. Sergio tried to calm things down and ended up stabbing his heart, killing him almost instantly.
The verdict issued last week by the Provincial Court of Madrid assumes that Donizete, now 24, is responsible for ending Sergio’s life with his little brother “by mutual consent”. A few weeks ago, the popular jury found the mother’s involvement unproven, prompting prosecutors and private prosecutors to point to her key role in encouraging their children to commit the crime.
According to the letter from the Ministry of State, which contained the statements of several witnesses that evening, the mother had screamed: “This is solved with knives in my country!” said the Brazilian-born woman. At the trial, some witnesses came to confirm that they did not remember what the mother had done, but they did remember that the father had encouraged them. The verdict ensures there are “serious and reasonable” doubts about Sandra’s role as an instigator or accomplice. “There is no record of the defendant exerting a psychological influence on her children,” he specifies.
The verdict reflects that the two brothers are contributory factors in Sergio’s death, although the fatal stab wound came from the minor in whose pocket the knife believed to be the weapon of the crime was found. The popular jury felt that Donizete dished out another knife that Sergio was able to fend off, injuring his forearm.
