Ana Castela is being sued for alleged plagiarism on 'Forced Bachelor'; Musician demands R$200,000 compensation G1

The singer Ana Castela has been sued by the musician Luan Kaique Vieira Castelan, who accuses her of plagiarizing his song “Lado Direito da Cama” and “Solteiro Forçado”, sung by “Boiadeira”. According to the proceedings, the compatriot is demanding compensation of R$200,000 for plagiarism and a request for withdrawal for “improper use”.

O g1 contacted Ana Castela's advisors, who said they had “no feedback on this case” and were “waiting for the relevant area.” The report also sought out Luan Castelan's lawyer, who said he was waiting for the dispute to unfold.

“The song scores were compared and we saw similarities. The lyrics are completely different, but the melodic line is similar. Luan’s song was registered in December 2019,” explains Ricardo Bockorny, Luan Castelan’s lawyer.

Ana Castela's music is a group composition. The rights to “Solteiro Forçado” are owned by seven people, including the singer from Mato Grosso do Sul. As mentioned, all composers are part of the process.

The case was heard in the São Paulo court but transferred to Londrina (PR), where Ana has a permanent residence.

“Forced Single” and “Right Side of the Bed”

Luan Castelan's lawyer argues that his client's song was registered in December 2019. Ana Castela's song was released on July 7th this year.

The cowboy's song has more than 160 million views on YouTube, while Luan Castelan's song has around 70,000 views.

In addition to moral damages, singer Luan Castelan is suing the singer for material damages, plagiarism, a claim to profits from Ana Castela's music and a public retraction by the singer.

“The lawyers who signed this clarification statement were contacted by the artist Luan Castelan's advisors amid allegations of plagiarism of the composition 'Right Side of the Bed'. The artist was surprised by the release of the song 'Single Forced' on Music and The defendants pointed out that the defendants interpreted the videos from music platforms due to the lack of attribution and permission to use the intellectual work, which culminated in the filing of the copyright lawsuit. As the proceedings continue, the copyright reasons will finally be properly proven.”
