Superior Court Judge Jean-Louis Lemay dismissed the defendant’s motion, which was filed earlier this week. At the same time, the judge ordered Guénette’s detention until the end of the trial, arguing that the defendant had failed in his obligation to assure the court that he posed no risk to society.
However, the detailed reasons for the decision are subject to a publication ban in order not to impair a possible process.
The body of Achraf Thimoumi was discovered lying in his car by a passerby on Stoneham’s Chemin des Familles on August 8, 2022. The 20-year-old man, originally from Morocco and based in Canada since 2019, was killed by bullets.
Two accused
Keven Prévost-Bouchard and Éric Guénette were arrested nearly three months after the murder. The two men are from Lac-Saint-Jean.

Prévost-Bouchard has previously been arrested in another count of violent crimes involving firearms and has a solid criminal record. As for Guénette, he had been convicted of burglary, fraud and theft in 2007 but had not received a conviction since.
Both individuals in this case are charged with first-degree murder.
However, the details of the murder brought to light when Guénette applied for provisional release are also subject to a publication ban. However, at the time of the arrests, the Sûreté du Québec had revealed that the murder was linked to the drug world.
