Judges have asked the defense of former junta president José Antonio Griñán, who asked for his detention to be suspended on December 23, to tell the court when his radiation therapy will be completed so that it can finally decide whether to serve He served his six-year sentence in the political part of the ERE case. At the same time, the judges have rejected the request of Agustín Barberá, former deputy labor minister of the Junta de Andalucía and in the same case sentenced to seven years in prison for embezzlement, he was the first of eight former senior officials of the Autonomous Administration to appear before the Provincial Court of Seville on 22 December ordered that all convicts be sent to prison. Barberá has 10 days to choose the prison where to serve the sentence.
The First Section of the Seville Court issued an order, also dated Thursday, ordering Griñán’s defense to tell the court that the former socialist leader has ended his radiation sessions. On March 21, the judges asked the former Andalusian President to produce the medical report on his state of health, as requested by the prosecutor and the private prosecution exercised by the PP, in order to decide on his detention after the court decided to postpone his admission , while completing his treatment for the prostate cancer he is suffering from.
The same Chamber argues that although Barberá “suffers from a serious and incurable illness”, given the medical treatment sent by his defense and the report from prison, “his treatment at this center can be carried out with the hospital examination. Oops that should be filed.” According to the medical conclusions contained in the order, the former Deputy Counsel takes oral medication daily and needs to be checked quarterly at the Puerta del Mar Hospital in Cádiz and every six months at the Virgen del Rocío Hospital in Seville.” Possible admission to prison should not affect the treatment,” the judges point out.
Griñán reported that the disease had stricken him a day after the court awarded the eight former senior executive officials 10 days in jail to serve out their respective sentences for fraudulently administering public aid from the ERE, a measure that was only taken for Barberá suspended while his medical report was known. Like him, the former Andalusian president accepted Article 80 of the penal code, which gives judges the discretionary advantage to stay the execution of the sentence if the person thought he was “suffering from a very serious illness with incurable conditions”. Then the coroner advised against being sent to a Griñán prison and the court decided, also after the opinion of the Ministry of State and the PP, to postpone the decision until the end of treatment, 23 daily radiotherapy sessions in the Virgen del Rocío. The defense has sent a letter to the court confirming that these sessions are ongoing.
