Prosecutors are calling the elderly Arizona rancher a “danger to society” and alleging he hunted migrants

The case against elderly Arizona rancher George Alan Kelly, who is accused of murdering a Mexican migrant by shooting him dead on his land last month, is heated today as both he and prosecutors disagreed with a judge Present versions of their story.

Kelly, 73, is in custody on a single murder charge for shooting Gabriel Cuen-Butimea on January 30. He told police and border guards that he fired warning shots when he saw Cuen-Butimea and at least eight other Mexican men walking through his country.

He said he mistook them for drug smugglers and wanted to scare them away, but was careful not to shoot them directly. Afterward, he called border police and the entire ranch was immediately searched, but no bodies were found. It wasn’t until hours later, while trying to find his horse, that he found the man’s body and called authorities again to report the death.

However, prosecutors say Kelly – who has no criminal record and lives alone with his wife Wanda – deliberately “chase down” the men with an AK-47 and that he later changed his story several times while speaking to police and border patrol .

They say he shot the “innocent man” Cuen-Butimea in the back while he was “running for his life” and base their case largely on the testimonies of two other men who have recently come forward and claim they are been there that day.

George Alan Kelly, 73, says he was defending his country when a group of up to 10 Mexican migrants ran across the country on January 30, firing guns and carrying backpacks and walkie-talkies. He is now charged with the murder of one of the men whose body was found on his property

Kelly is shown leaving the court in handcuffs. His bail has been converted from cash to security, meaning he can use his home to secure release. When and if that will happen is unclear

These men claim they were all migrants trying to sneak into America, but when Kelly started shooting, they jumped back over his fence and “made it back to Mexico.”

In court today, a judge agreed to convert Kelly’s $1 million bail into a bond, allowing him to use his 170-acre ranch to get out after nearly a month in prison.

He has also been charged with two counts of aggravated assault against “Daniel” and “Ramon” – the two migrants who have now come forward to assist prosecutors.

Prosecutors today said Kelly shot an “innocent man in the back as he fled for his life”.

A filing said the migrants posed “no threat to him or his family.”

“This type of unprovoked attack poses a significant threat to victims and the community,” Assistant District Attorney Kimberly Hunley said in the filing.

Kelly’s lawyer said the two men who came forward were fully believed by prosecutors – while all of his comments were under scrutiny.

She also pointed out that these men have only now come forward to testify, almost a month after the shooting, after the case has garnered national and international media attention.

“There is a very large incentive structure for people to enlist — people can get Dong immigration benefits like this. You can also give in to pressure from human traffickers who have an interest in blaming Mr. Kelly for this event.

“Certificates are bought and sold by drug dealers. It is a commodity and is used.

“The benefit they get here is security for their smuggling route through his property, and they are sending a message to everyone else that if you defend your property against us, you will be arrested and there will be witnesses.”

“There was no bullet. There were no witnesses. But the government jumps ahead and decides to indict first-degree first degree murder.

“This struck a match over a very intense political powder keg and predictably there was an explosion.

“This case was highly publicized, highly politicized. People have already pre-judged this case very loudly.

“Following this massive political explosion, random witnesses come forward. They only come forward after the fact – after the investigation has been compromised by the whole public – basically anyone can come forward.

“The state doesn’t seem to have checked any of these witnesses.

“The state doesn’t seem to be scrutinizing these testimonies in the same way as theirs, there seems to be a double standard and corroboration bias.”

Prosecutors, in their own filing, asked the judge to keep Kelly behind bars so witnesses – and the victim’s family – would feel safe in court.

KELLY’S VERSION OF THE STORY: GANG OF DRUG RUNNERS IN COMBAT BOOTS AND CARRYING TRANSCEIVERS WERE HEARD FOOTING THEIR GUNS AND RUNNING ACROSS HIS COUNTRY

The following description is from a motion filed in court by George Alan Kelly’s attorney.

On Jan. 30, George Alan Kelly reported the discovery of a body on his property near Kino Springs, where he and his wife have lived for two decades.

Earlier in the day he had been doing chores at his ranch and had come to his house to have lunch with his wife.

As they ate, Mr. Kelly heard a single gunshot. Next he saw his horse – which is old – frightened and running away at full speed. Eventually he saw a group of men moving through the trees around his house.

They were armed with AK-47 rifles, dressed in khakis and camouflage clothing, and carried large backpacks. None of them were known to him. He had not given any of them permission to come to his land. Based on the foregoing, Mr Kelly was understandably concerned and justifiably afraid for his safety.

He called the United States Border Patrol Ranch liaison to report what he had seen and to request immediate assistance. He told his wife to stay indoors, stay away from windows and keep quiet so as not to alert the men to their presence.

Mr. Kelly then went onto the porch with his rifle. The leader of the armed group of men saw Mr. Kelly and aimed an AK-47 directly at him.

Fearing for his life and safety, Mr. Kelly fired multiple shots from his rifle in hopes of scaring them away from his wife, animals, and home.

Mr. Kelly made sure to aim well over the heads of the armed group of men.

In a written defense presented to the court, Kelly's attorneys described how he was at home having lunch when he heard gunshots outside and then saw his horse running. He called the border police and later the sheriff's department. None of them initially found the victim's body

The group then began running into the desert surrounding his home. After the group fled, Mr. Kelly went to his barn to see if it was safe and secure.

Mr. Kelly had another call with the Border Patrol, which ended at 2:36 p.m…..while Mr. Kelly was checking his barn, some Border Patrol agents and the sheriff’s deputy arrived at the property.

[They] walked all over Mr. Kelly’s property in search of the group of people and found no one.

Later that day, as the sun was setting, Mr. Kelly went to his pastures to check on his horse. He took his dogs with him. After finding the horse, Mr. Kelly noticed his dogs focusing on something on the ground near a mesquite tree. Mr. Kelly approached his dogs and observed a body lying face down in the grass.

Mr. Kelly then called the Border Patrol Ranch Liaison again.

The body was that of a male foreigner. The person had no firearms or backpack with him. The cause of death appeared to be a single gunshot wound and the body appeared fresh.

The individual was carrying a radio and was wearing tactical boots, suggesting he may have been involved in illegal activities.

Mr Kelly does not believe any of his warning shots could possibly have hit the person or caused the death.

All shots fired by Mr. Kelly on the day of this incident were in self-defense and justified.

THE PROSECUTORS & MIGRANTS VERSION OF THE STORY: KELLY ARISED “UNPROVOCATED” WITH AK-47 AND STARTED SHOOTING “INNOCENT” MEN WHO “POSED NO THREATS TO HIS FAMILY”

The following description is from a file filed by Santa Cruz County Attorney George E. Silva and Assistant County Attorney Kimberly Hunley.

On January 30, 2023, at approximately 2:30 p.m., a group of approximately 7 to 8 undocumented immigrants from Mexico traveled north through the Kino Springs area. Contrary to Kelly’s portrayal, no one in the group carried guns.

The group, which also included RF-G and DR-R, was in sight of the Kelly residence when Kelly started shooting at them with an AK-47 out of nowhere. Kelly issued no warnings and made no requests.

He just started shooting at her. DR-R was just a step behind Gabriel when he heard Gabriel shout in Spanish, “I’m hit,” grabbed his chest and fell to the ground. He saw Gabriel’s eyes roll back in his head and when he could only see the whites of his eyes, he knew that Gabriel was dead.

He felt like they were being hunted. Kelly shot her at least 8 rounds. Both RF-G and DR-R jumped the fence and made it back to Mexico. Are ready and available to testify.

About 6 minutes later, Kelly called Agent Morsell again. This time, Kelly said he lost sight of the motives running toward Kino Springs. When asked if he was shot, Kelly claimed he heard a gunshot in his direction. He saw his horse run by and he inspected his horse but he didn’t seem stuck,

Kelly said it was “too far to tell if they have any firearms”. Border Patrol agents and sheriff’s deputies responded to the scene and walked the property. They didn’t find anything back then

Kelly called Agent Morsell again at 4:23 p.m. By this time, his story had changed significantly. He told Agent Morsell he was inside the house with his wife when “we” heard a gunshot.

He said he saw 10 subjects all loaded with AR assault rifles. He said his wife saw it too.

Then at 5:23 p.m. he tried to call Agent Morsell again. He left a message saying: “You need to call me immediately. That is serious. call me immediately I can’t say more on the phone.”

Agent Morsell returned his call. At this point, Kelly’s tone had completely changed. He sounded nervous.

Have Morsell send in Border Patrol because it’s a broader subject.

When Morsell asked for the details, Kelly continued to be evasive, saying, “This is bad. I need someone out here to answer.” You know how there used to be shooting, there might have been some shooting. I can’t say more on the phone.

One of the MPs turned on his phone’s recorder as they spoke and walked with Kelly. Kelly told him a shot had been fired and he didn’t know what it was about. He went out to get his horse.

He said he was “walking all over the place” and claimed “maybe that’s what happened after you left”, referring to MPs’ previous visit.

He said, “There’s a body over there, when I saw it I backed away from it.” Kelly later spoke to detectives. After initially denying firing at the group, he later admitted to firing.

He claimed he aimed his shots over the heads of the group.

Biden Putins suspension of US arms treaty big mistake.webp

Biden: Putin’s suspension of US arms treaty ‘big mistake’

WARSAW, Poland (AP) – President Joe Biden said on Wednesday that Russian President Vladimir Putin made a “huge mistake” in suspending his country’s participation in the last remaining US-Russia nuclear arms control treaty. The US President was in Poland to reassure NATO allies on the eastern flank that the US will stand by them amid the grueling Russian invasion of Ukraine.

In his first comments since Putin’s announcement on Tuesday, Biden condemned Russia’s decision to withdraw from the treaty known as New START. The move is expected to have an immediate impact on US visibility of Russia’s nuclear activities, but the pact was already alive after Moscow late last year cut short talks aimed at salvaging an agreement both sides had declared violating the others had accused.

“That’s a big mistake,” Biden said.

The president’s comments came as he capped a turbulent four-day visit to Poland and Ukraine with talks with leaders of the Bucharest Nine, a cluster of nations in the easternmost parts of the NATO alliance that had banded together in response to Putin’s 2014 annexation of the Crimea from Ukraine. He left Poland on Wednesday night to return to Washington ahead of the anniversary of the outbreak of war on Friday.

Concerns among the Bucharest Nine have continued to mount as the Ukraine war drags on, and many fear that if Putin is successful in Ukraine, military action may next be taken against them. The Alliance includes Bulgaria, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Romania and Slovakia.

“You are the front line of our collective defense,” Biden told the group on Wednesday. “And you know better than anyone what is at stake in this conflict? Not just for Ukraine, but for the freedom of democracies across Europe and around the world.”

He vowed that the NATO Defense Pact was “sacred” and that “we will defend literally every inch of NATO.”

A day earlier, at the foot of Warsaw’s Royal Castle to mark the somber milestone of the year-long Russian invasion, Biden warned that if left unchecked, Russian aggression will not stop at Ukraine’s borders. “The appetite of the autocrat cannot be appeased,” he said. “They must be fought.”

Hungarian Prime Minister Viktor Orban, the right-wing populist leader who argued last week that the European Union was partly to blame for prolonging Russia’s war in Ukraine, has rejected sanctions on Moscow and the arming of Kiev. Orban skipped the meeting with Biden, and President Katalin Novák attended in his place.

Nonetheless, Klaus Iohannis, the President of Romania, insisted that “the B9 is stronger than ever”.

NATO Secretary General Jens Stoltenberg, who attended the meeting, said: “We don’t know when the war will end, but when it does end we need to make sure history doesn’t repeat itself.”

Referring to previous Russian actions in Georgia and Ukraine, he added: “We cannot allow Russia to continue to interfere with European security. We must break the cycle of Russian aggression.”

Biden met in Warsaw on Tuesday with Moldovan President Maia Sandu, who last week claimed Moscow was behind a conspiracy to overthrow her country’s government using outside saboteurs.

Sandwiched between Ukraine and Romania and one of Europe’s poorest countries, the eastern European nation has historic ties to Russia but wants to join the 27-nation European Union. In his remarks, Biden supported Moldova’s application to join the EU.

“I am proud to stand by you and the freedom-loving people of Moldova,” Biden said of Sandu and her country in his Tuesday address.

Ever since Russia invaded Ukraine almost a year ago, Moldova, a former Soviet republic of about 2.6 million people, has sought to forge closer ties with its Western partners. Last June, it was granted EU candidate status on the same day as Ukraine.

Sandu spoke last week about a Russian plot “to overthrow the constitutional order”. She spoke out after Ukrainian President Volodymyr Zelenskyy said his country had intercepted Russian intelligence plans to destroy Moldova. These claims were later confirmed by Moldovan intelligence officials.

Biden’s speech on the Ukraine war came a day after his surprise visit to Kiev, a grand gesture of solidarity with Ukraine. The speech was partly a reaffirmation of Europe’s role in helping Ukraine repel Russia’s ongoing invasion and partly a stark warning to Putin that the US will not allow Moscow to defeat Ukraine.

The White House lauded several eastern flank countries, including Lithuania, Poland and Romania, over the past year for stepping up efforts to provide arms and economic aid to Ukraine and to take in refugees.

Biden has paid particular attention to Poland’s efforts. The country is home to about 1.5 million Ukrainian refugees and has pledged $3.8 billion in military and economic aid to Kiev.

“The truth is, the United States needs Poland and NATO needs the United States as much as NATO needs it,” Biden said in talks with Polish President Andrzej Duda.

That’s the amount of refining capacity the world has lost since 2019, according to S&P Global Commodity Insights.

Meanwhile, the International Energy Agency expects global demand for oil products to exceed 2019 levels by over 1 million barrels a day this year.

That gap, analysts say, is one reason gasoline, diesel and aviation fuel prices are likely to remain high relative to crude oil.

New refineries that could add 3 million barrels per day more capacity are slated to come online this year, says Rick Joswick, head of global oil analysis at S&P Global Commodity Insights. But it often takes a year or more for a refinery to reach its full potential.

“Refining capacity is expected to remain tight this year,” Mr. Joswick said, “with supply improvement largely lagging into 2024.”

So far, the refining deficit has pushed up jet fuel and diesel prices more than gasoline. But with the driving season approaching, some experts believe gas is poised to catch up as growing demand for gas will continue to weigh on refiners. Another factor could be a potential shortage of a muddy substance called vacuum gas oil, or VGO, which the US imported from Russia until recently.

“The real problem is this tiny market that nobody is looking at,” says Francesco Martoccia, energy strategist at Citigroup.

Moved to Las Vegas for residency, directing new music video (with Lori Harvey) and work-life balance

Usher has it bad for Las Vegas.

The Grammy winner, who is currently performing in Sin City for Usher: My Way The Vegas residency, says he moved to Vegas because of the music — and also because of his family.

“I started curating my own little world here, so much so that I actually put a flag in the ground. I actually moved here,” he told THR. “I’ve been here for a year. I’m not saying this is the be-all and end-all, but I have a place here to house my family.”

The residency at Dolby Live at the Park MGM has received rave reviews and he returns to the stage on Friday. And this week he announced 15 new dates for June and October, with tickets going on sale on Saturday.

“I’m trying to figure out how to balance my normal life of taking care of my kids and caring for myself. The only compliment is the fact that I have the opportunity to sit in one place and everyone comes to me instead of traveling across the country,” said the 44-year-old father.

In an interview, the eight-time Grammy winner behind hits like “Burn,” “Yeah!” and “U Got It Bad” talks about his residency, upcoming single and music video, a possible Super Bowl halftime appearance and more.

Usher Jemal Countess/Getty Images

How was performing at a residency compared to traveling around the world on a typical tour?

It is time consuming and very expensive to move like this. But one thing is the time you lose. The only benefit of being at home is that I get a chance to spend a little more time with my kids.

It’s a bit complicated during the school year, but it’s really fun in the summer. [Son] Usher is getting better at basketball, or at least he’s trying. And Naviyd, he’s found some really cool camps here and he’s made some friends here. My little ones, they are literally happy wherever they are. We live in this really cool mansion in the sky down here, so it’s pretty fun to be in the middle of the action and then come straight home and have your kids with you.

What was it like putting the residency together and also seeing such a great response from your fans?

nerve wracking. I’ve spent my life entertaining people – that’s the point where I get a chance to enjoy myself. So instead of thinking about what I need to do and wondering if everyone is getting enough of what they need, I do what I want to do. “Am I getting enough of what I need?” is the question. I get the chance to break a sweat and sing and relive some of those choreographic moments, and then I have spontaneous moments where I get people on stage to celebrate.

You recently teased your new song and video for “GLU” on Instagram. What can we expect?

Sean Garrett and Lil Jon, the last time they got together was amazing (on “Yeah!”) and then they added the funk that is the Avila Brothers, man, now it just goes to another level. The Avila Brothers played in my band during my last residency. We don’t do it anymore, but we make records together now. [The song is] based on the energy I think we’ve created here [in Vegas]. It prompted us to go back into the studio and make something that we can now serve. And Sean Garrett, he did it, man. He wrote a cracker.

Is the music video ready?

Yes. I decided to make my directorial debut with this one. Lori Harvey was my lead. I was shooting the video and because it was Valentine’s Day and I was so excited about what I was working on, I was like, ‘Let me just offer you something on Valentine’s Day. The Day of Love.” People love it, and now it’s ready to come out [and I’m] get ready to give it to the world.

The “New Flame” music video by Chris Brown and Usher.

What made you decide to direct this video?

I’ve always had some part in the creation of what I market or brand for my songs, but now I wanted to be in the director’s chair. I wanted to look through the actual lens and offer some of my vision and my take on how the song plays out, but I don’t take full responsibility. I had an incredible crew, an incredible co-director, Mike Ho, who I had worked with before. I actually saw him and Chris Brown doing New Flame and I witnessed the process that Chris went through. Clearly Chris has grown as a creative and is now making his own videos. It seems like an opportune moment for me to strive for something.

This song is about passion. This song is about a connection between this man and this woman. So I start spelling it out and writing it down. Me and LA Reid were talking about it when we were putting this music out together and he was like, ‘You know what? I think you should shoot it.” I thought, “Okay. Well shit why not? I’ll try if I can build a crew.” I have a great crew and great producers to help me achieve my vision. And art is far more than standing in a booth or dancing on stage. It’s also what people remember – the optics.

After Rihanna’s Super Bowl performance, there was talk of you doing the halftime show. Is this something you would be interested in?

It would be an honor to be asked. If there’s a conversation about that, apparently my fans would love to see it. If asked, I would definitely do it.

Usher’s 1994 single “Think of You.”

Next year marks the 20th anniversary of your Confessions album and the 30th anniversary of your self-titled debut album. What goes through your mind when you think about it?

man, that was a long time ago. Part of it is hearing people say that you don’t really understand how long you’ve been doing something until you look at your kids. But my child is 15 years old. That means I’ve been a father for 15 years. So my albums have always been viewed like my children. You know what I mean? I became like a 20 year old and a 30 year old.

I’m honored man. I’m really lucky that after 30 years I’m still able to put out music that people love. I still do things that are relevant at the time. I still represent all those who paved the way, but pave [my own] way at this time. A whole family can come and enjoy [me as] an artist. You’ve got grandma, you’ve got mom, you’ve got the son and you’ve got the daughter – that’s a lifelong goal for any artist to be able to say that their whole family can come and enjoy a show or performance like three generations of music.

Titans release longtime LT Taylor Lewan WR Robert Woods

Titans release longtime LT Taylor Lewan, WR Robert Woods

Turron DavenportESPN12:36 PM ET2 Minute Read

NASHVILLE, Tenn. — The Tennessee Titans took several steps Wednesday to get below the salary cap, releasing longtime left tackle Taylor Lewan, wide receiver Robert Woods and kicker Randy Bullock.

The Titans were $23.3 million over the salary cap prior to Wednesday’s move. The releases of Lewan ($14.8 million), Woods ($12 million) and Bullock ($2 million) saved the Titans approximately $28.8 million from their cap.

Lewan, a three-time Pro Bowl offensive lineman, was the No. 11 draft pick in 2014. Lewan, 31, entered the final season of the five-year, $80 million contract he signed in 2018.

“I hope I’ve done enough to create something for all Titan fans to be proud of, love you all,” Lewan posted on his private Twitter account.

The nine-year veteran was the longest-serving player on the Titans roster. Lewan had two ACL surgeries in three years that limited him to playing just 20 games over the last three seasons.

Lewan’s most recent cruciate ligament tear occurred in Week 2 last season against the Buffalo Bills. Now Lewan has to decide whether he wants to continue playing football.

He was released with a failed physical designation.

The Titans traded a 2023 sixth-round pick to the Los Angeles Rams last year for Woods, who sustained an ACL tear in November 2021.

Woods, 30, worked his way back from injury and played in all 17 games last season. Woods, a 10-season veteran, had 53 receptions for 527 yards and two touchdowns in his only season with the Titans.

Bullock, 33, made 17 of 20 field goal attempts and was good on all 28 extra point attempts last season.

War in Ukraine live I call on the United Nations

War in Ukraine, live: “I call on the United Nations to set up a special tribunal for the crimes of Russian aggression,” explains Olena Zelenska at the UN

Olena Zelenska pleads with the UN for a special tribunal so that “aggression” like the Russian invasion of her country “cannot be repeated”

“I call on the United Nations to set up a special tribunal for Russian crimes of aggression. We’re not the only ones who need it, it’s for everyone so it can’t happen again. »

“I think you will all agree: regardless of your country and nationality, you have the right not to be killed in your own homes,” Ukraine’s first lady Olena Zelenska said in a video message delivered during a special event in the United Nations Headquarters was broadcast on human rights violations in Ukraine. “However, for a year now, Ukrainians have been being killed in front of the whole world in their cities, villages, homes, hospitals, theaters,” she added, defending Ukraine’s right to “self-defense.”

Ukrainians have been pushing for months to create such a tribunal to try those responsible for the invasion of Ukraine. They had considered presenting a resolution on the anniversary of the start of the invasion, but the initiative was rejected, according to diplomats. The resolution, which will be discussed by the General Assembly on Wednesday, calls above all for a “just peace”, hoping for the greatest possible support.

The International Criminal Court (ICC), which has opened investigations into war crimes and crimes against humanity in Ukraine, has no authority to try aggression crimes against Russia, which has not signed the Rome Statute, founding text of the ICC.

“Russia has committed all sorts of crimes against the Ukrainian people,” Ukrainian Foreign Minister Dmytro Kuleba condemned and castigated in particular the “deportation of Ukrainian children to Russia.” “Responsibility for international crimes committed in Ukraine must be comprehensive, there must be no loopholes. Russia’s political and military leaders must also be brought to justice,” he stressed.

In this regard, the European Union recently announced the creation of an international center dedicated to prosecuting crimes of aggression in Ukraine, supported by Ukraine and based in The Hague. This center “will collect evidence that can one day be used to judge Russian leadership,” Dutch Foreign Minister Wopke Hoekstra said at UN headquarters on Wednesday. “Yes, we want peace, but the only way to get peace is not to tolerate this aggression,” he added.
