Hamza Mbareche will regret his evening of March 5, 2018 for a long time. The man with several diplomas and the desire to become a teacher had accompanied his then wife and a work colleague to the pubs to celebrate.
However, as the evening progressed, the drunk victim had trouble getting up. The couple had then made the decision to bring her home to take care of her.
DNA confirmed
The 29-year-old had been lying on the couch with repeated vomiting. Mbareche then suggested that his wife go to sleep while he tended to the victim.
This was when full sexual assault took place.
Traces of DNA were found on the victim, which left no doubt about a full and unprotected sexual relationship.
The 36-year-old had pleaded for mutual consent, but Judge Christian Boulet ruled that the victim’s consent could not be valid.
Therefore, a prison sentence of 26 months was ordered. The defendant’s lawyer, Me Stéphanie Pelletier-Quirion, has already appealed the verdict.
