An armed intruder attempting to enter a North Carolina property with a handgun was shot in the neck and seriously injured by a homeowner.

Police were called to the 300 block of Andrews Street in Mount Airy at 4:20 a.m. Tuesday afternoon.

They found suspected burglar Daniel Scott Laskey Brown, 26, lying in the front yard of homeowner Joshua Wade Murphy, 41, bleeding from a gunshot wound to the neck.

Mr Murphy once fired in a confrontation with Mr Brown when the intruder attempted to enter the house armed with a handgun.

Mr. Brown was hit in the neck and taken to Atrium Health Wake Forest Baptist Medical Center.

North Carolina permits the use of deadly force in the defense of a property, a policy often known as the Castle Doctrine.

But the Surry County District Attorney’s Office will not file charges against either of them, police said.
