Dany Fortin-Tremblay recognized as a dangerous criminal?

Dany Fortin-Tremblay had to kill five people before the judiciary tried to check him further. When he was arrested at Place du Royaume two years ago for kidnapping and confiscating a young woman, he could be classified as a dangerous criminal.

Dany Fortin-Tremblay was due to appear back in court for his sentencing, but the criminal and prosecuting attorney ruled otherwise.

“The prosecution is requesting a stay of reprieve as we need to explore the possibility of filing a motion to have the gentleman declared a controlled or dangerous offender,” said Me Karen Inkel, Criminal and Criminal Attorney.

This procedure occurs in rare cases, since the accused must have received heavy sentences in the past. This is Fortin-Tremblay’s fifth case of serious violence against women.

“If the judge agrees to this referral, Herr will be evaluated by either a psychologist or a psychiatrist from the Philippe Pinel Institute and at the moment they are completely overwhelmed and the deadlines are very, very long,” explained Me Olivier Théorêt, a defense attorney at Legal Aid.

The results of the psychiatric evaluation at the Pinel Institute could result in Fortin-Tremblay being classified as a dangerous or long-term offender. However, delays of more than 60 days are to be expected.

“Pinel is very late. We recently had a case where it took six months for the person to be evaluated. If the period of time before the assessment is too long, the defense can request bonuses in the statute, which are cruel and unusual in extending the assessment period,” Me Théorêt pointed out.

If the repeat offender is declared a dangerous offender, he faces an indefinite sentence. If he is instead declared a long-term offender, the accused must be closely monitored after serving his sentence and can be arrested again for the slightest misconduct.

The court date is set for next Monday to give the DPCP time to begin this lengthy process.

“This is a serious request, it must be approved by our immediate Chief Prosecutor, who will then make the assessment and determine whether or not I would be eligible to submit this request next week,” Me Inkel said.

Two scenarios are therefore possible next Thursday. If the application is submitted and then accepted, Pinel will require Dany Fortin-Tremblay to be assessed in order to be recognized as a dangerous or long-term offender. If necessary, he will plead for his punishment.
