Transgender woman forced to use men’s locker room sues New York yoga studio for $5 million

A transgender woman who was forced to use the men’s locker room at a New York City yoga studio is suing the company for $5 million.

Ali Miles, also known by the name Dylan Miles, was born a natural male but is in the process of transition [a] woman”, wears women’s clothes and undergoes hormone therapy.

Management at Hot Yoga Chelsea, where classes can cost up to $1,900 a year, banned her from using the women’s locker rooms and restrooms on May 4.

But Miles went in anyway, and according to the lawsuit, it caused complaints from the other women there.

It is the third gender identity discrimination case she has filed in the city in the past 13 months, according to the New York Post.

Miles, originally from Arizona, showed up at the Manhattan studio before the 5 p.m. class and was about to change in the women’s dressing room.

But her presence sparked complaints and she was told to stop using the facilities and to leave.

“Female guests … complained and yelled at Miles about Miles’ presence and use of the changing rooms and toilets marked as ‘female’ for same-sex guests and asked Miles to leave and stop using the facilities,” the statement said complaint.

A witness described Miles’ behavior that day as disturbing, saying she was “150% male” and her genitals were hanging out in the dressing room.

“We have other transgender people [at Chelsea Hot Yoga]We have several trans women and several trans men and there has never been a problem. … it’s that person,” she told the New York Post.

“This person, claiming to be a transitional woman, walked into the women’s locker room, number one, in men’s shorts that came down to her knees.

Although it could be hormonal since his bust size is larger than mine, he wasn’t wearing a female top to cover his bust size.

“He has also undressed and is a full man.” It’s 150% men. There were things hanging around.’

The witness added, “It wasn’t even like he just stood there.” He crouched on the floor in front of the shower stalls.

“One of the women there was very uncomfortable, she was completely naked.”

“This person immediately started reciting the law, and why would you do that?”

“Because that person could see that there were also other women below me who were particularly upset … That person, I don’t know if they’re coming to those places to try to start an issue or whatever.”

Miles was also represented by attorney Peter Sverd in her case against Planet Fitness, where she was allegedly escorted out of the women’s locker room, and against a homeless shelter, where she claimed to have been assaulted by a security guard.

Both incidents are believed to have happened in the Bronx.

According to a 2016 New York City law, public accommodations must allow visitors to use the restroom consistent with their gender identity.

Or they must provide single toilets for “all genders”.

Businesses in New York are said to be doing their best to avoid problems with toilet use.

Property manager Anthony Mignano, who is not a party to the lawsuit, said: “Our lawyers have instructed us to change everything…now everything has to be neutral to avoid that.”

While another expert claims transgender entitlements to restrooms and locker rooms could hurt businesses in the city through litigation, similar to what’s happening with the Americans with Disabilities Act.

This led to hundreds of lawsuits, including some by plaintiffs described as “professional plaintiffs,” who filed dozens of lawsuits.
