Kevin Costner says estranged wife Christine refuses to move out of home, violating her prenuptial agreement

Kevin Costner has filed legal documents asking a court to force his estranged wife, Christine Baumgartner, out of his home in accordance with their prenuptial agreement.

The Oscar-winning actress, 68, said she had 30 days after Baumgartner filed for divorce on May 1 to move out of the home he owns under the terms of their prenup, TMZ reported on Tuesday after reviewing the legal documents in the case.

The Dances With Wolves actor and director told the court he believes 49-year-old Baumgartner is staying at home to convince him to give in to “various financial demands” she’s making as a result of the split.

Costner said he had already given Baumgartner $1.45 million as part of the prenup, providing enough money to purchase a new apartment.

The Yellowstone star – who has three children with Baumgartner – sons Cayden, 16, and Hayes, 14, and daughter Grace, 13 – told the court he was willing to make further financial arrangements to allow them to leave the property move.

Costner said in the court filings that he was “willing to contribute $30,000 a month towards a rental home as part of his child support obligations and is willing to advance another $10,000 for her moving expenses.”

In court filings, he said he was the sole owner of the three family homes; and per the prenuptial agreement they agreed to at their 2004 wedding, Baumgartner agreed to leave home and take their belongings with them in the event of a divorce.

Costner has a massive real estate portfolio, highlighting a 10-acre beachfront property in Carpinteria, California that is estimated to be worth $145 million.

The house is situated on a cliff and offers sea views. Costner originally designed a dream home with a pool and guest house, but family commitments and spending a lot of time at his Aspen home meant he never got around to redesigning the grounds.

The grounds include a 500-foot stretch of private beach surrounded by cliffs, and the actor has built what appears to be a vacation home on the property, surrounded by patio furniture and umbrellas.

Originally there was a polo practice field on the property, which baseball fan Costner converted into a baseball field. The home also offers views of the Santa Barbara Mountains, several islands and a private horse trail.

Already owning a home on Carpinteria Beach, Costner bought a 17-acre property with a modest two-bedroom, two-bathroom ranch in 2006 for $28.5 million. Costner noticed the house when he saw a for sale sign while jogging past.

In 2007, the JFK star sold seven acres of land to a neighbor but combined his homes into one contiguous estate.

In a recent interview with Deadline, Costner noted that he had pawned a piece of his property to raise money for his upcoming Horizon film franchise.

“I mortgaged 10 waterfront acres in Santa Barbara where I was planning to build my final home,” Costner said. “But I did it without thinking about it. It sent my accountant into a freaking dizzy spell. But it’s my life and I believe in the idea and the story.”

Costner also owns a 400-acre ranch in Aspen, Colorado that includes two lakes. The property comprises three separate houses with a total of eight bathrooms and twelve bedrooms and can accommodate up to 34 guests.

In late January, Costner put the property known as Dunbar Ranch up for rent at $36,000 a night.

Baumgartner, who has worked as a model and handbag designer in the past, filed for divorce from actor “The Bodyguard” on May 1.

Their relationship began in 1998 and they had exchanged vows in 2004 at his ranch in Colorado.

After announcing the separation, Costner’s rep, Arnold Robinson, said in a statement, “It is with great sadness that circumstances beyond his control have arisen which have resulted in Mr. Costner having to attend a divorce of the marriage.”

Costner “wasn’t shocked” when he heard about the divorce filing, sources told People last month, but the news still came as “an unpleasant surprise.”

“It’s not what he wanted.” “However, he knew Christine was unhappy,” the source said.

Costner’s busy work schedule has affected the relationship, the source added, as she wanted “they to spend time with family at their home in Santa Barbara,” but he “isn’t around often” when he’s filming.

The insider said, “His absence has been very hard on her.” Christine doesn’t want him to rush into another project. He’s been obsessed with filming Horizon since last year. She wasn’t happy about that.’

The veteran actor is also father to daughters Annie, 39, and Lily, 36, and son Joe, 35, with ex-wife Cindy Silva; and son Liam, 27, with ex-girlfriend Bridget Rooney.
