The band accused SBT of unethically “luring” Danilo Gentili.
Gentili had a contract with Band at the time, but went to SBT with his team, stating that he had received an “irrefutable” offer. Since then he has presented “The Night with Danilo Gentili”.
The band told the court that with this irrefutable proposal, SBT violated the Brazilian broadcasting code of ethics, which describes the recruitment of artists under contract as unethical behavior.
He also stated that SBT had practiced unfair competition.
“It was very easy for SBT to hire members of the rival company and copy their respective programming when it already had an audience thanks to Band’s work and the notoriety of Band’s received programming,” he told the court.
SBT defended itself by arguing that people have the right to freely pursue their profession without being judged for seeking other employers.
