The Provincial Court of Málaga has sentenced two football players from the El Palo team to four years in prison for stabbing another Alhaurín de la Torre CF player after a match in the third regional league, the eighth category of the sport, in 2016. The prosecution originally demanded twelve parties, but eventually reached an agreement after the first trial was declared null and void in 2021 and the defendants have already paid much of the compensation awarded in that trial. It took him 200 days to recover and even today he is regularly examined “because the scar in the pericardium and heart muscle is susceptible to cardiac arrhythmias, aneurysmal dilatations with the possibility of thrombus formation and pericardial adhesions leading to constrictive pericarditis and cardiac problems “can fail,” as it is expressed in the sentence.

The attackers were tried in February 2021. The public prosecutor then demanded twelve years in prison for each of them for the crime of attempted murder. During the trial, the players denied that they jumped onto the pitch with the intention of attacking the opposing captain. The perpetrator of the stabbing then said that he didn’t have a knife but a nail clipper, that he got into a fight on the field and that he acted out of fear, which he regretted. However, the court sentenced the two defendants to ten years in prison each in April of the same year, but the defense appealed, believing that the judge had “lacked impartiality” in the trial. The Supreme Court of Andalusia agreed with them and ordered the trial to be repeated.
Before it happened again, the parties involved in the case – defense, prosecution and private prosecution – agreed in September this year to keep the sentence at four years in prison, Diario Sur reported this morning. In the case of Salvador, as the perpetrator of a crime involving serious threats in connection with a crime of attempted murder, for which exactly Moshine is found guilty. The decisive factor for the reduction in sentence was the mitigating circumstance of the payment of damages, as both paid 77,300 euros into the judicial account as compensation for the injured. This means that the victim, who is to be paid a total of 72,624 euros, and to a lesser extent also the person who tried to stop the perpetrator of the knife attacks and was also injured in the process, must be paid 7,669 euros. The ruling frees Club Deportivo El Palo and Malaga City Council from civil liability.
