On her birthday on Monday (16), 94yearold actress Fernanda Montenegro filed a lawsuit against her neighbor for damages. Fernanda says her house was flooded due to irregular renovation work at the site.

O Q5 had access to the trial document being heard at the 15th Civil Court of the TJRJ (Court of Justice of Rio de Janeiro). He is against businessman Sandro Chaim, owner of Chaim Entratenimento, a company that produces plays and shows in Rio. The case occurred at the end of the first half of this year.

Fernanda says her apartment in the Ipanema district, south of Rio de Janeiro, started leaking because her current neighbor made structural changes to the apartment without the condo’s approval. A tenant in Fernanda’s apartment complained about the incident and took action. Since February 2022, she has been trying unsuccessfully to resolve the case without going to trial.

According to Fernanda’s defense, a recently renovated closet was severely damaged by infiltration in May. Termites started attacking the entire house. Fernanda’s current tenant plans to move out due to the problems.

Fernanda Montenegro requested an injunction ordering the resident of the building to renovate her apartment to correct the problems caused and also to compensate her for moral damages in the amount of R$20,000.

The actress says that the moral damage is due to the devaluation of the property, whose value is estimated at R$2 million. Fernanda says she cannot rent the property at market value because of the problems.

Judge Flávia Justus rejected the injunction. In their opinion, “further evidence of the origin of the leak is required so that the work can be carried out.” A conciliation hearing was also ruled out due to the urgency of the case and its specific features.

In the coming weeks, the judge should consider the merits of Fernanda’s proposed matter. An exact date has not yet been set.
