Jogger accused of killing homeless man who blocked his path

A California man is accused of shooting a homeless man who was sleeping on the sidewalk, blocking his path, on Sept. 28 and filming the scene as he jogged on a sidewalk a few miles north in South Los Angeles .

The man in question, Craig Summer Elliott, 68, is charged with voluntary manslaughter and using a firearm during the commission of a felony.

Mr. Elliott was running with his two dogs and pushing a shopping cart when he came across homeless man Antonio Garcia Avalos, 40, sleeping on the sidewalk, the Orange County District Attorney’s Office reported in a statement.

He then allegedly tried to wake Mr. Avalos with his basket, but when he woke up, he called out to Mr. Elliott and told him to leave.

The homeless man then threw a shoe in his direction and Mr. Elliott responded by firing three times in his direction.

Mr. Avalos was seriously injured and subsequently died.

The whole thing was filmed by the defendant.

“It is tragic that circumstances surrounding such a small inconvenience as a blocked sidewalk have developed in the worst possible way,” District Attorney Todd Spritzer said in a news release.

Mr. Elliott was arrested and formally charged.

He will be back in court on December 15.
