Model and presenter Ana Hickmann’s request for divorce based on the Maria da Penha law was rejected by the judge of the 1st Criminal Court of Domestic and Family Violence in São Paulo. The information was released on Wednesday morning (29) by the lawyer of Alexandre Correa, husband of Ana Hickmann.

According to lawyer Enio Martins Murad, the controversial divorce application will be processed by the family court after the court decision.

“I entered through Maria da Penha. The law is there to protect us. It was created because of a woman who was a victim of it and many others who were also victims. The law, which is getting stronger, protected me,” he said Ana Hickmann.

Divorce under the Maria da Penha law

The Prosecutor of the Ministry of State of São Paulo (MPSP), Celeste Leite dos Santos, explains what has changed in the Maria Penha Law after the changes that came into force in October 2019.

“The change in the law allows the judge of the Domestic and Family Violence Court to order a divorce himself. In situations where there is no aggression against women or children, the divorce is regulated by the family court. This change takes into account that the victim is at risk and the separation process needs to be faster,” explains Celeste.

Businessman accuses parental alienation

The businessman’s lawyer said that Ana Hickmann “forbids Alexandre from spending time with her son.” He also stated that he requested the right to family life based on Article 2 of Law 12,318/2010.

The moderator’s office said that Hickmann had already carried out all the clarifications and was confident that the case would be handled by the courts.

According to the files, the model reported to police at the scene that she was in the kitchen of the family’s home around 3:30 p.m. Next to the couple was their 10yearold son and two employees.

Ana Hickmann told police that she was talking to her son and that her husband did not like the content of the conversation and began reprimanding her, increasing his tone, which startled the couple’s son, who left the room.

According to BO, the model reported that after the argument, Alexandre Correa pushed her against the wall and threatened to headbutt her. She stated that she managed to push her husband away and take the cell phone, but at that moment Alexandre closed the sliding kitchen door and squeezed her left arm.

According to the files, Ana Hickmann said she managed to lock Alexandre outside the house and called the police. When police arrived at the residence, Alexandre was no longer there.
