Tommy Lee was sued over an alleged sexual assault that occurred in a helicopter in 2003. The plaintiff claims the Mötley Crüe drummer forced himself on her in the cockpit during a 40-minute trip from San Diego to Van Nuys, California.
In the lawsuit, filed Friday (Dec. 15) in Los Angeles and obtained by Rolling Stone and The Blast, the unnamed woman, who was then working as a bank teller in San Diego, said she struck up a friendship with a pilot the name David Martz. He invited her to fly on his helicopter and she eventually agreed, although she was hesitant at first. The day she arrived for the helicopter ride in early 2003, Martz told her Lee would be joining them.
Once the helicopter was in the air, the woman claims both Martz and Lee began drinking alcohol, smoking marijuana and snorting cocaine. She claims she did not take drugs or alcohol, but was forced to climb into the cockpit and sit on Lee's lap to get a better view. The plaintiff then says in the lawsuit that Lee began “forcibly groping, kissing and penetrating her with his fingers and attempting to force her to engage in oral copulation.”
The lawsuit states: “At some point, Lee penetrated Plaintiff with his fingers while caressing her breasts. Lee then pulled down his pants and attempted to push plaintiff's head toward his genitals. At this point the plaintiff burst into tears, but she had nowhere to go – she was trapped and had little mobility to exit the cockpit.”
She claims Martz “just observed” the alleged attack before they eventually dropped Lee off in Van Nuys and flew back to San Diego “in silence.”
The plaintiff broke off contact with Martz, but spoke to him briefly by telephone in 2009 when he attempted to contact her. Martz later died in a Cessna crash in 2015. Records show that Martz lost his pilot's license three times over the years, including once for allegedly having oral sex with a porn star during the flight and another time for attacking Lee had dropped off at an airport at a Nine Inch Nails concert on a public street.
In her statement of claim, the woman says she suffered “great shock, distress, humiliation, shame and guilt” and did not report the incident at the time because she did not believe she would be taken seriously.
The lawsuit states: “These feelings, coupled with Lee's fame and the climate of the music industry at the time (in which rock and roll stars like Lee thrived and gained even more notoriety through lewd and hedonistic behavior) led her to me.” “I believe that reporting Lee and Martz’s behavior to local law enforcement would do no good.”
The lawsuit filed against Lee and some helicopter companies alleges sexual assault, gender-based violence, intentional infliction of emotional distress and negligence. The woman is seeking unspecified damages for medical costs and loss of earnings.
The plaintiff also believes that Martz and Lee also used the helicopter to lure other unsuspecting victims. Rolling Stone attempted to contact Tommy Lee's representatives but received no response.
