Florida: Lawsuit over chocolates that do not correspond to the image on the packaging

A Florida woman has filed a $5 million lawsuit against Hershey after the company allegedly “deceived” her with “deceptive” packaging for seasonal Reese's chocolates.

Cynthia Kelly of Tampa claimed the shapes of the chocolates depicted on the packages did not match those of the products – including pumpkins, ghosts, footballs, bats, snowmen and candy bars.

“The Hershey labels for the products are materially misleading and many consumers have been deceived and misled by the images on the product packaging,” according to court documents obtained by the New YorkPost.

The American decided to continue the business after buying pumpkin-shaped chocolates. She said she was disappointed not to see the eyes and mouth engraved on the chocolates, as shown on the packaging. She also added that she would not have purchased the product, which sold for $4.49, if she had noticed that the information on the label was missing.

The class action lawsuit, if successful, will “affect all consumers in Florida who purchased any of the products.”
