The resident of a Sherbrooke condo is being evicted from his building for harassing his neighbors. This is the decision made by the Supreme Court in a judgment on January 4th. It was not the first time that legal proceedings had been initiated against him.
Jean-Yves Lévesque, 80, has to leave the condominium he lives with his partner on February 5th.
The story begins with a simple request. The Château Bellevue co-ownership association would like a storage device and a scooter to be removed from the communal garage as this is prohibited. Mr. Lévesque refuses, the union terminates him at the beginning of summer 2023 and the situation worsens.
Between June 24th and July 3rd, a community toilet was contaminated with human excrement, dirt was spread outside the building's entrance, objects were thrown into the swimming pool, chairs fell to the ground, soap was poured into the fountain outside and… This Word “WAR” was written in molasses on a wall.
The union's leader, Maurice Jubinville, wants to raise awareness among other co-ownership unions. “We cannot stop at these people, at this type of character. Justice can help us get this far, we have the tools,” he emphasized.
A history that goes back a long way.
In 2013, Jean-Yves Lévesque also had problems with former owner representative Maurice Guertin. After his death, a letter from Mr. Lévesque was found. In it we read: “TOO LATE, YOU’RE GONE.” The place was chosen in the garage. I dreamed for six months about slitting your throat and putting your rat face on the hood of your tank.
He then sent a letter to Maurice Guertin's widow, quoting: “The rat is dead. Cry that you are happy.” WELL DONE! GOODBYE FOREVER! DAMN OLD STEW.”
The harassment has been going on for a long time. “We are not in favor of people laying down the law in a condominium building,” concluded plaintiffs’ lawyer Me Frédéric-Antoine Lemieux.
Jean-Yves Lévesque wrote on social networks that he “will try to overturn this second verdict, but at the cost of a lot of money and trouble.” This is an option that the finally released residents do not want.
