A judge is investigating the government delegate in Madrid for using tear gas during the Ferraz protests

The head of the Instructional Court No. 49 of Madrid, Josefa Bustos Manjón, has opened an investigation into an alleged crime of subterfuge against the government delegate in Madrid and the police commanders who carried out on November 6 the orders to release gases tear gas against demonstrators in the Near Ferraz Street, the federal headquarters of the PSOE, which has called for protest against the upcoming inauguration of Pedro Sánchez and the implementation of the amnesty law.

In the order, to which this newspaper has had access, the judge agrees to open a preliminary hearing to determine the nature and circumstances of this event and “to name the people who took part in it” and is directed against the Government delegate Francisco Martín Aguirre and against the police commanders who carried out the orders, as well as “other persons criminally responsible for the events”. The court chairman forwarded the complaint to the public prosecutor's office to report on its admission.

The judge opened the trial only for the alleged crime of subterfuge, one of the four crimes charged in the complaint, which also charged the defendants with the crime of unlawful dispersal of a peaceful assembly, bodily harm and torture, and breach of moral integrity .

The plaintiff association is violating the Democratic Memory Act. The protest on November 6th was one of the largest recorded since the beginning of the month, with 3,800 participants, according to the government delegation, and so far the protests have taken place near the PSOE's federal headquarters in Madrid, with the number of participants decreasing.
