Texas parents sue Apple after son suffers ‘permanent hearing loss’ from Amber alarm in his Airpods

  • A Texas couple is suing Apple for over $75,000 in damages after their son was injured by his Airpods.

  • The parents said their 12-year-old was using his Airpods when an Amber Alert blasted through at high volume.

  • The child suffered an eardrum damage and will need a hearing aid for the rest of his life.

A Texas couple is suing Apple after their son suffered “permanent hearing loss” while using his Airpods.

Carlos Gordoa and Ariani Reyes of San Antonio, Texas are seeking over $75,000 in damages after their 12-year-old son suffered hearing loss when an Amber Alert went off while he was using his Airpods.

The incident happened in May 2020 when Gordoa and Reyes’ son, named BG in the lawsuit, was watching Netflix with his Airpods, which had been purchased new six months earlier.

“BG was watching Netflix on his iPhone connected to the AirPods at a low volume when suddenly and without warning, a yellow alert went off at a volume that ruptured BG’s eardrum, damaged his cochlea and seriously injured BG’s hearing. ‘ the lawsuit says.

The child has also “suffered from dizzy spells, dizziness and nausea” as well as mental anguish and emotional trauma since the incident, the lawsuit states. He will have to wear a hearing aid for the rest of his life.

“At the age of 12, BG suffered a sudden and permanent hearing loss in his right ear,” the lawsuit reads. “BG has lost his ability to lead a normal life and will continue to lead a restricted life including reduced earning capacity.”

The lawsuit also alleged that the family will have to deal with medical bills for the foreseeable future “due to the broken AirPods.” The lawsuit alleges the devices are defective in design or lack adequate warnings of the risks of use.

Apple didn’t immediately respond to Insider’s request for comment.
