Ximbinha is suing Joelma after announcing ‘This is Calypso’ tour
Ximbinha went to court to fight for recognition of the band Calypso’s copyright, seeking profits and moral damage compensation in addition to Joelma’s performances after she announced the This is Calypso tour.
However, Judge Roseane Cristina de Aguiar Almeida denied Ximbinha’s request for early guardianship after Joelma announced the return of her new tour, This is Calypso.
He comments on this in the lawsuit filed by Ximbinha felt shattered, sad and frustrated, after learning the singer was using the name “Banda Calypso” to promote her latest work. Ximbinha also explains that it was previously agreed in another court case that neither he nor Joelma would use the term again.
Ximbinha then says that he arranged all of the musical compositions of “Banda Calypso” and that he was never approached by Joelma’s team for negotiations.
The musician then filed a lawsuit against the singer, claiming, among other things, that the singer was banned from performing and performing certain songs from “Banda Calypso” under threat of a day sentence to be determined by the court.

The judge denies Ximbinha’s motion against Joelma
However, Judge Roseane Cristina de Aguiar Almeida maintained that the conditions set out in the law for granting guardianship were not met. Because there’s not exactly an official ban on using the old music group’s name.
In addition, the judge alleges that Ximbinha requested the suspension or interruption of performances of “Banca Calypso” works in all media, so it makes no sense for him to simultaneously require his name to be inserted into the compositions and arrangements from the music.
The judge also notes that there is no risk of irreparable damage as he can financially compensate Ximbinha if the mark is proven to have been used improperly.
