Shocking moment Texas lawyer pulls out a GUN and tries to shoot his ex-girlfriend dead in a bar

A lawyer was caught on video pulling a gun on his ex-girlfriend at a Texas bar and allegedly firing three shots before clients grabbed him.

Gavin Rush, 41, was then released on $40,000 bail just two days later, despite being charged with aggravated assault with a deadly weapon in connection with domestic violence.

Rush, who works on “sexual assault, embryo destruction and fertility center misconduct, complex commercial disputes, civil rights lawsuits, FINRA arbitrations and financial services disputes,” according to his LinkedIn page, only had to pay 10 percent of that, or $4,000.

The low bail was set even though Rush had previously been charged with assault/family violence against another woman in 2017, although the case was eventually dismissed.

The incident happened around 11:30 a.m. on Saturday November 26th at the Anderson Mill Pub in Austin.

Rush’s ex-girlfriend, who could not be identified, works at the bar and he went there to confront her as she did not appear to be speaking to him.

According to Fox 7 Austin, the woman and Rush apparently split about a month and a half ago after three years of dating.

Surveillance video posted to Twitter by a local council member named Mackenzie Kelly shows him placing a leather bag on top of the bar.

Rush’s ex continued to refuse to speak to him when he arrived at the bar, according to a police affidavit.

He then pulled out a pistol and aimed it at her, a red dot from a laser sight pointing straight at her chest, and fired, narrowly missing her.

The affidavit says Rush fired at least three times before being pinned down, one shot hitting a bar mirror behind where the ex-girlfriend was standing.

One of the customers who pinned Rush told KVUE that he even tried shooting himself in the head but failed as they got between him and the trigger.

Two customers approached Rush and held him on the ground until police could get there.

One of them later told the local news: “We’re all just lucky. It could have turned out so differently than it did. Thank God.’

Rush’s profile page was deleted by the law firm — Peiffer Wolf Carr Kane & Conway — where he works.

They said in a statement: “Gavin Rush no longer works at the company. We do not tolerate hate or violence of any kind. Our thoughts are with the victims who suffered severe trauma that day.”

Rush’s ability to get out of prison so quickly has alarmed both local politicians and police officers.

Thomas Villareal, chief of the Austin Police Association, said: “This particular case appears to be one where the courts have failed this victim.”

Councilor Kelly, who posted the video on Twitter, added: “This lawyer belongs behind bars awaiting a long jury of his peers.”

Travis County District Attorney Jose Garza was asked about Rush’s $40,000 bond. Garza, whose website says one of its missions is to “treat all victims with dignity and respect,” blamed a city judge.

He told CBS Austin, “I don’t know what information the judge had before them when they made that decision. Under state law and local practice, the district attorney’s office and prosecutors are generally not present when bail is posted. That’s something municipal judges do without input from the district attorney’s office.’

Garza — a Democrat and member of the far-left Democratic Socialists of America, Jacobin said — said they aren’t typically allowed to interfere in judges’ decisions, adding that the district hopes to launch a program that will allow it Allowed prosecutors to be present at these hearings.

Rush was charged with assault/family violence by obstructed breathing/circulation against another woman in another county in 2017, but the case was dismissed after he completed anger management courses, according to the KVUE.

The judge granted Rush’s ex-girlfriend and emergency protection order against him when bail was set.
