Biden evaluates immigration policy after the end of US Title 42

Washington, Dec. 3 – U.S. President Joe Biden’s administration is considering a proposal that would ban migrants from seeking asylum at the United States-Mexico border if they could be granted sanctuary in another country, news reports today .

This measure would be motivated by the end of restrictions on the controversial public health agency known as Title 42, which will be inactive in three weeks.

According to analysts, the new policy, if approved, would mirror the asylum restrictions imposed in the Donald Trump era (2017-2021), which drastically curtailed migrants’ ability to seek asylum in the United States if they stayed or traveled through other countries to reach the border.

The proposal was included in a memo sent to the White House by the Department of Homeland Security (DHS), CNN reported.

“The government has pledged to continue to secure our borders while maintaining a safe, orderly and humane processing of migrants. This will continue to be the case when Title 42 is suspended,” said Marsha Espinosa, DHS spokeswoman.

According to various estimates, the flow of migrants will fluctuate between 9,000 and 14,000 people a day until mid-December, numbers more than double the number of people currently crossing.

Title 42 was first asserted under Trump in March 2020 and drew widespread criticism from immigrant advocates and public health experts, but last month Judge Emmet Sullivan upheld his decision until midnight on December 21, CBS News pointed out.

Border authorities used the restriction to deport almost 2.5 million more migrants in less than three years.
