Dave Chappelle attacker sentenced to 270 days in jail after storming onto stage at Netflix festival

The man who attacked Dave Chappelle on stage during his performance at Netflix’s Is a Joke Festival in May has been convicted.

Isaiah Lee has been sentenced to 270 days in prison after pleading not to contest a misdemeanor charge and a charge of entering a restricted area during a live event, a Los Angeles Attorney General’s spokesman confirmed to PEOPLE.

A judge previously denied Lee’s attorney, assistant public defender Chelsea Padilla,’s request to participate in a mental health diversionary program, which could have resulted in the charges being dismissed, according to the Los Angeles Times.

Padilla did not immediately respond to PEOPLE’s request for comment.

Lee, 24, currently remains behind bars after being charged with attempted murder for allegedly stabbing his roommate in December 2021.

The charges were brought by Los Angeles County District Attorney George Gascón, according to a press release in May.

Officials said Lee was charged after he allegedly stabbed his roommate during a fight at a transitional shelter on December 2, 2021. He committed the assault, which he previously reported to police,” Gascón said.

“The publicity generated by the attack on Mr Chappelle helped the police solve this crime,” Gascón continued. “The incident that occurred at the Hollywood Bowl was a misdemeanor and was properly referred to the city’s Attorney’s Office. Due to the nature and severity of the attack in December, Mr. Lee now faces criminal charges, which my office will prosecute.”

During a performance at the Hollywood Bowl in Los Angeles in May, Chappelle, 48, was thrown to the ground after a man in a black hoodie stormed onto the stage, PEOPLE confirmed. The attacker, who police later identified as Lee, then attempted to flee but was stopped by security guards and members of Chappelle’s team.

After the attack, several other people went into action to help Chappelle, including Chris Rock, who performed earlier in the night. A witness told PEOPLE that Jamie Foxx also jumped onto the stage and “got involved in the scuffle.”

Police initially said Lee would be charged with assault with a deadly weapon — he allegedly carried a “replica handgun slashing knife” — which is a felony, but on May 5 a spokesman for the Los Angeles County Attorney’s Office gave one up Statement to PEOPLE, which said in part that the bureau “referred the case to the Los Angeles City Attorney’s Office to file a misdemeanor review.”

Hours after the case was referred, LA City Attorney Mike Feuer announced new charges against Lee. “The suspect was allegedly carrying a gun,” Feuer said of the “replica pistol with a knife.”

“There must be consequences for this alleged assault, and this afternoon my office filed charges of allegedly assaulting, possessing a weapon with intent to assault, and charges of disrupting a performance,” he added.
