A federal judge granted government investigators access to email messages about Republican Rep. Scott Perry of Pennsylvania, the official whose cell phone was confiscated by the FBI in August, it was revealed Friday.

US District Court Judge Beryl Howell ruled that emails between Perry and other figures fighting former President Donald Trump’s campaign were not protected by privilege.

These included 37 emails between Perry, former DOJ officer Jeffrey Clark, attorney John Eastman, and Clark’s aide Ken Klokowski, a former senior counsel in the DOJ’s Civil Division. That made them fair game for the investigators conducting the wide-ranging investigation into January 6 and the election-coup efforts.

The decision came in an unsealed judgment in June, Politico reported. The judge also ruled that a stack of about 331 documents belonging to Clark – who featured prominently in the Jan. 6 House Committee public hearings – were not protected in a September attorney-client privilege order.

It was also revealed that Perry was in frequent contact with former Trump White House Chief of Staff Mark Meadows following the release of texts obtained by the Jan. 6 committee.

In one, he wrote to Meadows a week after the November 2020 election, which had since been called for Joe Biden: “Mark, these are instructions from the cyber forensics team. Please ensure the widest possible distribution and action. Please tell every head of state that they must: 1. Store the specific voting machines (scanners) used in the polling stations where the error occurred. (Put them under lock and key – no one touches them),” followed by more detailed instructions.

Perry shared with Meadows another unsubstantiated allegation of voter fraud on November 12, after pointing to a conspiracy theory apparently involving CIA Director Gina Haspel and the voting machines of Britain, the National Security Agency and the Dominion.

“Believe me, I’ll do everything I can, including calling her to you. Also, our State Department seems to have all of its systems on April 2nd/3rd. shut down in October and lost all of its data, necessitating the replacement of all of its hard drives. I don’t know if it matters yet, but state legislative examiners are making that record for their subpoenas next week,” he wrote.

“DNI must order NSA to immediately seize international communications related to Dominion and begin searching – was Chinese malware involved?” Perry wondered in another text. He called for an audit of “their overseas accounts with the CIA.”

Part of Judge Howell’s decision related to an autobiography that Clark appears to have drafted — despite being a relatively obscure middle-level official that Trump hoped to install as acting attorney general in his final week in office.

This led to mass termination threats from other DOJ officials.

Clark outlined the autobiographer in October 2021, according to Politico, which said it included a description of the angry Jan. 3, 2021 White House meeting at which White House attorneys met Eastman, a former law professor at Chapman University whose name has , Clash was circulated as part of a group of potential criminal referrals the January 6 Committee is working on.

In August, Perry demanded the return of his phone and its contents. He then sued for the return of the material, arguing that his talks and data as a member of Congress were protected by the “speech and debate” clause of the constitution. He dropped the suit in October.
