An eyewitness at Tory Lanez’s trial told the court he saw the singer, his driver and Megan Thee Stallion’s assistant Kelsey Harris kick and punch the rapper as she lay on the ground with gunshot wounds.

Sean Kelly, whose Hollywood Hills home overlooks the site of the July 2020 shooting, took the witness stand Tuesday and told the jury he thought the trio tried to kill her.

He told the court Lanez yelled at Megan using words like “motherf***er” and the N-word “a barrage of abuse.”

“He went insane. He was really excited,” added Kelly, whose dramatic testimony as a defense witness was often contradictory depending on whether the prosecution or the defense were asking the questions.

He told the court Lanez “shot everywhere four or five times,” but also said he believes “the girl” (Kelsey Harris) “took the first shot.”

Lanez, 30, who wore a powder blue suit and white turtleneck in criminal court in downtown Los Angeles on Tuesday, has pleaded not guilty to three counts of assaulting Megan with a semi-automatic firearm, a weapon concealed in a vehicle to have carried and discharged a firearm with gross negligence.

The Canadian musician – real name Daystar Peterson – could face up to 18 years in prison if convicted of all three crimes, plus possible deportation.

In her testimony last week, 27-year-old Megan told the jury of seven women and five men that she and Lanez went to a pool party at the home of Kylie Jenner — who may be called as a defense witness — on July 12, 2020 and were in his SUV in the Hollywood Hills with Megan’s assistant and best friend Kelsey Harris when an argument broke out.

Megan, whose real name is Megan Pete, asked the driver to stop the car and she got out – after which she said Lanez yelled “dance b***h” and fired a gun at her several times, causing her to self Her feet were so badly injured she had to have an operation.

She also testified that Lanez offered her and Harris $1 million to keep quiet about the shooting.

Lanez, who is out on $350,000 bail, later apologized to her and said he was intoxicated at the time of the shooting.

Meanwhile, his defense team has theorized that it wasn’t Lanez but Harris who fired the gun at Megan in a fit of jealousy and anger when she found out the singer had “stabbed” her by using Lanez had slept, who Kelsey had fallen in love with.

Kelly told jurors Tuesday that he was awakened at around 4:30 a.m. by screams and loud voices in the driveway outside his home.

He got up to investigate, went to the balcony of his second floor bedroom and two girls fought in front of a car.

“They pulled hair and hit each other. It was pretty violent,” he said.

The “bigger guy” (Lanez’s driver) got out of the car and walked around the girls to try to separate them, Kelly told the court.

“Then I heard what I thought were fireworks … I saw a muzzle flash around the same time the smaller gentleman (Lanez, who is 5ft 3in) got out of the car.”

He said the first muzzle flash was “near the girls” but when defense attorney George Mgdesyan asked him, “Who had the gun?” Kelly said: “I’ve never seen a gun. I only saw lightning.’

“Where did you see the lightning coming from?” asked the lawyer. “The girl (Harris),” Kelly said.

“Did you ever hear someone say, ‘Dance b***h’? Kelly was asked and the answer was “No”.

Mgdesyan asked Kelly several times, “After seeing the woman shoot, did you see the smaller man come up to try and take the gun away from her?”

Kelly kept pointing out that everything moves very quickly, and in a sarcastic response that drew giggles in the crowded courtroom, he said, “It’s not like he said, ‘Excuse me, can I have the gun, me.’ my turn

At Mgdesyan’s urging, he added that he believed the girl (Harris) “fired the first shot…. Then I think he (Lanez) started shooting.”

After the shooting, Kelly said he saw Megan “crawl and trip” in the nearby driveway and “the three[Lanez, Harris and Lanez’s driver]hit her.

“She was curled up on the floor in a fetal position. They hit them all, punching and kicking them…. It seemed to me that they were trying to kill her.’

When Lanez’s driver said police were on their way, he continued: “They picked her up and looked like they were going to throw her in the (nearby creek).

“They dragged her across the street, put her in the car and ran away.”

Under cross-examination by Assistant District Attorney Alex Bott, Kelly said, “I saw the muzzle flash as the smaller gentleman (Lanez) got out of the car.

“He shot everywhere – four or five shots.

“The kid got out of the car and then shot the girl. She kicked all the time. She fell in the middle of the street.”

Kelly told Bott that after she was shot, she “crawled away and curled up into a ball.” And Lanez yelled a torrent of insults at her, including words like “mother****er” and “n****r.”

“He went insane. He was really excited,” he added.

Later in the day, Mgdesyan called LAPD detective Ryan Stogner — the lead detective in the Lanez case — to the witness stand Tuesday to testify about an interview he conducted with eyewitness Kelly a few days after the shooting.

“Did (Kelly) tell you he saw my client (Lanez) holding a gun and shooting a gun…? “No,” Det. Stogner replied.

Then, when Assistant District Attorney Kathy Ta asked him if Kelly had told him he saw a woman shoot or hold a gun, his answer was the same — “No.”

Stogner also interviewed Megan after the shooting and when Ta asked him “Who shot her?” The detective replied, “Your friend Tory Lanez.”

And when Ta Stogner asked if Megan had also told him that Lanez had offered her $1 million to keep the incident quiet, he replied, “Yes.”
