A Montrealer who got his own mentally disabled daughter pregnant has just been convicted of all charges, despite his denial and attempts to blame one of his children.
“The theory that one of the defendant’s sons is the father [de l’enfant] is not plausible, it is pure speculation. It was the defendant who got her pregnant [sa fille] during sexual intercourse,” Judge André Perreault said on Monday in the Montreal courthouse.
The 52-year-old defendant, whose name has not been released to protect the victim’s identity, committed his crime in 2015 when his 20-year-old daughter, who had struggled with many difficulties, moved in with him.
“The relationship was friendly, she considered him a friend,” said the magistrate.
However, during this year of living together, the unworthy father did not hesitate to take advantage of his daughter. According to her, sex was weekly and sometimes forced.
“She felt obligated,” the judge explained.
According to the victim, the father threatened her on several occasions, for example by mentioning that he would “kill her and throwing her in the garbage” or by assuring that he would “let men rape her”. .
The young woman eventually became pregnant. She broke off, but doctors took samples from the fetus that made it possible to determine that the parent was the victim’s own father.
At trial the defendant attempted to extricate himself by attacking the definition of incest. He then swore it was his daughter who “initiated” the acts, only to say full relationships never existed.
At one point, he even tried to cast doubt on the DNA test, saying it may have been his own son who attacked his daughter.
However, none of these claims convinced the judge. After reviewing all the evidence, he concluded that the defendant did in fact commit the crime of incest.
The unworthy father, released on bail, will appear in court for his sentencing hearing in the next few months. In the meantime, a psychiatric report and another, sexological, are being prepared.
