The NLRB’s Region 20 Division in San Francisco claimed Friday that the NLRB alleged that

CNBC reported that Musk sent emails to Twitter employees detailing his expectations, even saying, “Any manager who falsely claims that someone reporting to them is doing a great job or that a particular role is important is, whether remote or not, will be terminated by the company.”

“If you physically make it to an office and don’t show up, the resignation will be accepted,” Musk said, according to the NLRB. This led to several workers expressing “concern and outrage” over the order to immediately return to the office, according to the original charging document filed in March.

Yue then tweeted: “Don’t quit, let him fire you. You literally have nothing to gain by resigning.” She also posted a message on a company Slack channel that said, “Don’t get fired. Seriously.”

Many of Yue’s colleagues responded to her messages, the indictment says. Meanwhile, Musk also directed his management team to scan all online posts and Slack “to determine who should be fired,” the document said.

Five days later, Yue was fired and told she was violating an unspecified company policy, the legal document said.

“Ms. Yue alleges that Twitter singled her out for firing in retaliation for her attempt to motivate her colleagues not to resign so that they would have a better legal basis to challenge a separation from Twitter,” the document says.

The NLRB alleges that

“After 12 great years and 3 weeks of chaos, I am officially fired from Twitter,” Yue said in one tweet on November 15th. “I never expected I would have stayed this long and I never imagined I would be so relieved to be gone.”

The NLRB said it seeks to “compensate Yao Yue for any direct or foreseeable monetary damages, as well as other consequential damages, suffered as a result of defendant’s unlawful conduct” and to “provide any other relief that is just and appropriate, to remedy the situation.” the alleged unfair labor practices.

A hearing on the case is scheduled for January 30 in San Francisco.
