After a conflict over a dog, two men attack with ax and hammer

A 39-year-old man has just been convicted of seriously injuring a stranger with an ax after a simple run-in with a degenerate dog in Montreal in September 2021.

The defendant in this case, Mahamadou Doumbia, first crossed the sidewalk Stéphane Morien walking in the opposite direction with his pet on September 15, 2021.

“[Le] The applicant’s dog blocked his way. A brief verbal altercation ensued between the two men over the dog,” we report in the decision made by Quebec Court Judge Flavia K. Longo this week.

Two days later, the two men met again. After exchanging “snide words,” Mahamadou Doumbia stepped on the victim’s animal that had approached him.

The gesture led to a brawl in which the two men fell between vehicles.

Blinded with anger

After the altercation, Stéphane Morien became aware of the extent of the injuries the animal had suffered at his home.

“He loses his mind and goes to the defendant’s house with an ax to get revenge. Knowing that the defendant is a roommate in a building, the plaintiff asks the concierge about the exact location of his apartment, then he goes to his house.

Arriving at the door of Doumbia, however, Stéphane Morien decided to go through the emergency door.

In the ensuing seconds, Mahamadou Doumbia emerged from his quarters with a hammer in his hand and was surprised by the victim’s presence, sparking a new violent confrontation.

Stéphane Morien, who was trying to close the emergency door, fell to the ground after being hit with a hammer. At that moment, the accused took the opportunity to grab the victim’s axe.

For example, Doumbia “hammered and axed the plaintiff, who was still trying to close the door by putting pressure on it with his legs.”

After the authorities intervened, Stéphane Morien spent ten days in hospital to treat serious injuries.

In addition to being beaten to the chest, leg and left arm, he suffered a fractured skull.

During testimony in court, the victim reported that he had scars on his head, had a deformed skull and suffered from memory loss.

The court wanted to determine in its analysis whether Doumbia could have acted in self-defense.

“The defendant acted unreasonably under the circumstances from the moment he reopened the emergency door and struck the plaintiff with an axe.”

Mahamadou Doumbia, convicted of assault, is expected to be sentenced in the summer.
