Following the complaint by Alianza Lima, Universitario and Cienciano, the public prosecutor’s office opened an investigation against the judge who had approved the interim measure in favor of the association. For this reason, La República spoke to the lawyer Diego Guerrero of the intimate club, who gave more details of the case.
Due to the dispute over the broadcasting rights of the league 1, Alianza Lima, Universitario de Deportes and Cienciano filed a criminal complaint against Judge Juan Varillas, who had jurisdiction to grant the interim measure (MC) to the Peruvian Football Federation (FPF). This approach prevented the clubs from marketing their television rights individually, which is why it has led to controversy among the clubs concerned, mainly because they accuse a hasty judgment that did not do justice to the relevant processes. For this reason, the public prosecutor’s office has decided to initiate preliminary proceedings against Varillas Solano. With this in mind, La República was able to get in touch Diego GuerreroCounsel for the Victorian Club, who elaborated further on the issue.

-Who are the accused?
—The defendant is an adjunct judge of the Seventh Commercial Court of Lima, Juan Gustavo Varillas Solano. Mr. Varillas was charged with crimes against public administration in the form of passive bribery, passive corruption and in addition, influencing the state. He has issued two precautionary measures in favor of the association.
It’s important to consider the precedent, Varillas already knows a case of that FPF in 2022 which we have not dealt with and which has become media. It was a case against GolPerú. In doing so, it also issued a precautionary measure in record time and without taking the necessary legal requirements into account. The association then files another commercial lawsuit seeking ownership of the broadcasting rights of League 1 and…coincidence! contends he falls before the same court of Mr Varillas and takes precautionary measure again in record express.
It is also an absolute precaution that television has left without football. Subsequently, the federation has tried to give the MC a different interpretation, but he himself admits his mistake when asking for a variation of it. This change is all the more serious since the judge varied this legal route without following the respective procedural steps: he did not rule on the answer to the complaint Peruvian Soccer ConsortiumNeither about their resistance to the MC, nor about the request of the clubs to be part of this process. He skipped all these steps and issued the MC variant. Because of this suspicious speed with which the judge worked, Alianza Lima, Universitario and Cienciano filed this complaint
– In addition to the complaint from “U”, Alianza and Cienciano, is there another complaint from GolPerú?
-The Peruvian Soccer ConsortiumIn exercising his right to violate the precautionary measure, Judge Varillas has reported to the National Board of Justice (JNJ), who has already initiated a preliminary investigation based on the evidence in his possession, which may result in a disciplinary sanction. I would like to urge the prosecution and the JNJ to show the appropriate speed and vigilance that the cases that are now in their hands must have in order for justice to be served and for there to be a functioning judiciary.
After the complaint did you receive any reply or communication from the FPF or from the judges themselves?
—No, formally there was no communication.
– You are also a witness, could you tell us about it?
“Yes, we will also testify in the prosecutor’s investigation because we have requested to enter the process in which the precautionary measure was issued in order to defend our rights as victims, because if the contracts are suspended, the losers are clubs and also the fans. The moment they want to join us, they don’t give us an option and take their time to make a statement; However, to vary precautions, this is happening very quickly and with a suspicious speed, which is why we too will comment on it.
—While the investigation continues, does the precautionary measure remain in place?
– Yes, it is a court decision that can only be changed by another.
Could this investigation by the public prosecutor’s office lead to the lifting of the security measure? If so how long would it take?
– It might be possible to prove that an irregular action was actually taken, but I can’t give you approximate times. The public prosecutor takes care of that.
—Until these investigations are complete, will Alianza not participate in League 1?
-That’s separate. These are measures against officials who are suspected of having acted incorrectly. This is also a way of rendering the precautionary measure ineffective, but not the only way.
— This precautionary judge’s inquiry, could it delay the start of League 1?
I don’t know, probably yes. First we have to solve the problem of security and the guarantees of the public institutions to be able to hold the games, at the moment this was not possible due to the circumstances in the country. Once this is resolved we will see what happens.
Has there been any progress in broadcasting Alianza Lima matches?
“No, not so far.” The position remains the same.
—Clubs on the FPF side requested that Universitario, Sport Boys, Municipal and Mannucci be granted $500,000. Did Alianza receive this money?
-Not. Actually, I don’t know why this $500,000 is being paid, it must have some concept. Does the money really come from 1190 Sports? We have sent a letter to the FPF asking for information on this because it is announced that they will deliver this amount, but we do not know where this money came from. We have not received a reply, there are several communications that have not received a reply.
