Dollarama will have to defend itself in court in connection with the sale of recyclable bags that are not actually recyclable, one of Quebec’s largest sorting centers has found.

The centerpiece of the suitcase is a green bag sold by the Dollarama chain. At the top it says in big letters “I am reusable and recyclable”. However, if the first statement is true, the second would not be true, according to a class-action-law filing by law firm LPC Avocat.

According to the lawyer, it is therefore a misrepresentation on the part of Dollarama. And people are deceived, he says, using the example of a customer of the chain. This woman, who is at the forefront of the process, explains that she regularly bought these bags and then tossed them in her green bin when they were at the end of their lives.

“If she had known they were going to end up in a junkyard or landfill, she would never have bought them,” the court document said.

Me Zukran accuses Dollarama of trying to ride a green wave and is asking for permission to file a class action lawsuit against the retail giant on behalf of all consumers who bought the bags.

In particular, he is demanding that the company stop labeling these bags as recyclable, as well as compensation for any buyer. And lest the company be tempted to do so again, he’s asking for $10 million in punitive damages to be distributed among the group’s members.

Unless an agreement is reached, the application will shortly be presented to a judge in the Superior Court of Quebec.
