A California judge has disputed the application of James Tupper, a former partner of the late actress Anne Heche, to be named guardian of her son Atlas. According to documents obtained by website Page Six, the court found Tupper had failed to provide enough evidence to prevent Homer Laffoon the eldest son of the star who died in September from becoming his halfbrother’s legal guardian.

Phipps, told the website: “We are pleased but not surprised by the court’s decision this morning to deny James’ application for the appointment of a barrister for Atlas. We look forward to the court deciding Homer’s application at the next hearing, and in the meantime Homer will diligently administer the estate in accordance with his powers as special administrator.” The appeal hearing will take place at the end of November.
