The affidavit obtained by CNN says Cherry Hill police officers were called to a Doubletree Hotel on Aug. 13, where two victims “said they were sexually assaulted by the same actor,” identified as the defendant.
“They reported being in a photo shoot area during the Monster Mania event and having their picture taken with the defendant. During the photo shoot, the defendant placed his face near one of the victim’s breasts and asked where she got them from before attempting to undo her bra strap,” the affidavit reads.
The other woman reported that Busey, 78, grabbed her buttocks during the photoshoot, the affidavit said. The next day, a man reported that his daughter was sexually assaulted by the actor and that she told investigators he grabbed her during a photo shoot, the affidavit said.
Busey had no comment earlier Tuesday when CNN came forward and refused to say if he had legal representation in the matter.
CNN contacted Busey again Tuesday night for comment on the affidavit’s claims.
Busey denied allegations of sexual misconduct to TMZ when the outlet met the actor at a Malibu gas station Monday, TMZ reported.
He said he was “not inappropriate at all” and that he had eyewitnesses.
“None of that happened,” Busey said. “Nothing happened. Nothing. It was all wrong.”
Detectives contacted Busey and the affidavit states that he “first denied groping anyone before asking the detectives to apologize to the victims, then asking the detectives to stop the victims from making complaints, and claimed that it is sometimes possible to accidentally touch someone in a certain part of their body,” the affidavit reads.
A law firm representing Monster Mania told CNN in a statement Saturday that it was assisting authorities in their investigation and that immediately upon receiving a complaint from an attendee, “the celebrity guest was removed from the convention and instructed not to return.”
A criminal complaint says Busey is due to appear in Camden Superior Court at 12pm on August 31.
Busey faces charges including two counts of criminal sexual contact (fourth degree), one count of criminal attempt/criminal sexual contact (fourth degree) and one count of molestation (offence involving disordered persons).
CNN has reached out to the Cherry Hill Police Department and the Camden County Attorney’s Office for comment.
Busey is best known for his portrayal of Buddy Holly in the 1978 film The Buddy Holly Story, for which he was nominated for an Academy Award for Best Actor.
