Brian Flores files letter against sending case to arbitration

As PFT notes shortly after former Dolphins coach Brian Flores announced his lawsuit over racist NFL hiring practices, going to arbitration could lead to a derailment of the lawsuit. Today, Flores’ lawyers filed a motion against it.

Flores and his lawyers argue that the case should be heard within the legal system in open court, not in private arbitration.

“The lawsuits we have filed relate to important issues of systemic racial discrimination and the integrity of NFL football games,” Flores said in a statement. “Unfortunately, the Dolphins and their attorneys Quinn Emanuel and Paul Weiss are attempting to steer the Dolphins’ claims into secret arbitrations that lack transparency. Legislative efforts are currently underway to end involuntary arbitration of racial discrimination claims, which I fully support. I hope the NFL and the Dolphins will support this effort as well. Now Commissioner Goodell must make a choice. Will he allow this case and future racial discrimination lawsuits to play out in a transparent and public litigation, or will he continue down the same unacceptable path?”

Flores wants the case he has filed to be heard in public, and his referral to arbitration will keep the case under wraps.
