Rosengart said that in their appeal of Judge Brenda Penny’s July 27, 2022 decision, Jamie and his legal team “made unreasonable, unreasonable and abusive efforts to obtain Britney’s testimony.”
“By denying the appeal ‘entirely’ with respect to Britney’s testimony, the appeals court’s decision makes it clear that that will not happen,” Rosengart said. “As we have maintained throughout, her injunction was both legally baseless and morally despicable and the bullying and harassment of Mr. Spears and his attorneys should finally stop.
“They abused the process, were rebuked by the court and should move on.”

Judge Penny ruled in July that Britney’s testimony was not an essential factor for Jaime to frame his defense in the case and that relevant information on such matters could be obtained from separate witnesses and documents, TMZ reported after reviewing the legal documents in the case.
Jamie’s legal team had argued that he could not effectively justify Britney and Rosengart’s allegations without deposing the pop star.
Rosengart told the court that Britney was traumatized by her father and his long association with the conservatory and that testifying would only add to the trauma she experienced.
