This comes after Federline gave Ex-Spears a deadline to approve his plan to move their sons to Hawaii — or he will go to court to get a judge to approve the move, TMZ reports.
Federline has sole custody of Sean Preston, 17, and Jayden, 16, and is looking to relocate from LA with his children and wife Victoria in August.
Federline’s attorney Mark Vincent Kaplan told the publication he had asked Spears’ attorney Mathew Rosengart “several times” to send a letter or email stating that the 41-year-old pop star “agreed with the move” but he received nothing.

Kaplan adds “there shouldn’t be a problem with the two boys,” saying that Federline has 100% custody and de facto 100% custody, and claims Spears hasn’t had their sons for “more than a year.” seen.
Kaplan has given Rosengart a deadline of Friday to respond – after which he will file legal documents requesting an eviction.

It comes as Britney’s marriage to Sam Asghari is reportedly in “major trouble” as the couple have “screaming arguments”.
And now, Britney could face even more heartache when her two boys move hundreds of miles away to Hawaii in July.
Kevin has reportedly asked his attorney, Mark Vincent Kaplan, to send a letter to Britney’s attorney, Mathew Rosengart, asking if she would be ok with her sons living in Hawaii permanently.
According to TMZ, Kevin’s attorneys expect a response within the week. If she refuses, he will call a judge and ask for permission – but sources don’t expect it will come to that.
A source told the publication the reason for the move is that Victoria has a job offer, Kevin could get a job as a DJ, while the boys could have a more private life away from the busy Los Angeles scene.
They added that Jayden would be able to attend classes remotely, while Sean would have already graduated by that time.
