Britney Spears is not required to sit for testimony requested by her father Jamie’s legal team in the singer’s ongoing guardianship case, a judge in the case decided on Wednesday.

Jamie’s attorney Alex Weingarten last month called for the Grammy winner, 40, to be removed from office over the “incendiary allegations of various facts” she made via social media about Jamie’s actions at the helm of the conservatory.

The judge in the case said Britney’s testimony was not necessary for Jaime to establish his defense and that relevant information regarding it could be obtained from separate witnesses and documents, TMZ reported Wednesday after reviewing legal documents in the case.

Jamie’s legal team said he could not effectively defend the allegations made by Britney and her attorney, Mathew Rosengart, without impeaching the pop singer.

Rosengart told the court that Britney had been traumatized by her father and his dealings with the conservatory for more than 10 years and that testifying would only add to the trauma she experienced.

TMZ reported Tuesday that Rosengart had filed legal documents saying he would proceed with documents, physical evidence and only Jamie’s testimony.

Rosengart insisted that Britney’s testimony was not relevant to a trial and that he would not call her as a witness if the case went to court, as the fact that she was not named did not “gut” any reason why she should be removed .

The ongoing legal battle revolves around Britney’s allegations that her father violated conservatory rules and stole from her when he was assigned to manage her finances.

However, Britney’s attorney told the court that he believed trying to press Britney to testify was “retaliation” and “abuse of legal process” amid an attempted investigation into Jamie’s handling of funds and alleged surveillance of the singer .

The attorney said the … Baby One More Time singer couldn’t testify about matters at the conservatory because she was the one who lived under it and that she would be traumatized again if she asked herself any questions about it.

Rosengart, who has been representing the Toxic artist since last year, suggested that Jamie’s legal team should depose either Jamie or Britney’s ex-CEO Lou Taylor in order to get information about the deal.

Earlier this month, Jamie was ordered by a Los Angeles Superior Court judge to take part in a deposition about his actions as head of the conservatory, to which the pop star served for more than 13 years.

Judge Brenda Penny ruled that Jamie, 70, must schedule affidavit by Aug. 12 after previously being served affidavit by Britney’s attorney and failing to appear, Page Six reported.

Rosengart said in legal documents filed in May that Jamie was “ran and hidden” before the impeachment and must “account for his wrongdoing – under oath – as required by law”.

Another issue that came up in court was Jamie’s request that Britney’s estate cover his legal fees after conservatory graduation last November.

After being dropped by his former legal team, Jamie hired Weingarten at around $1,200 an hour, Variety reported last year.

Rosengart told Page Six Jamie’s petition was “not only legally baseless,” but under the circumstances of the case, “an abomination.”

The ongoing legal battle comes eight months after Britney was finally freed from the controversial legal guardianship that her father and a court-appointed guardian have held over her for years.
