Lawyers for Bryan Kohberger have filed legal documents showing the 28-year-old has an alibi for the November 13, 2022 murder night in Idaho.

Kohberger, 28, who is charged with four counts of first-degree murder, claims he was “walking alone” when Kaylee Goncalves, Madison Mogen, Ethan Chapin and Xana Kernodle were stabbed. However, he has not presented any evidence or witnesses to support this at this time.

“It’s not a real alibi defense,” Neama Rahmani, former federal prosecutor and president of West Coast Trial Lawyers, told . “It’s more about cross-examining the government witnesses and arguing by inference because.” [Kohberger’s] “The phone wasn’t there, Kohnberger wasn’t there either.”

According to law enforcement, Bryan Kohberger’s phone went offline at 2:44 a.m. in Pullman, Wash., and remained off or on airplane mode until it resurfaced following the killings in Idaho, south of Moscow.

The suggestion that Kohberger drove around in the early hours of the night, which his lawyers say he has “long been in the habit of doing,” could potentially be used in court to explain alleged CCTV footage of his car driving near the crime scene, for example at the time of the murders.

Kohberger claims he cannot say for sure where he went that night and has no one to corroborate his alibi, but claims he was not at the victim’s home, 1122 King Road.

“Currently, there is no specific witness who could pinpoint the exact whereabouts of Mr. Kohberger at any point between the late night of November 12, 2022 and the early morning of November 13, 2022,” his attorney wrote in court documents.

Kohberger will return for a court hearing on August 18 on multiple motions, including a defense request to have his current indictment dropped.
