Judge Eric Scapim Cunha Brandão of the 24th Civil Court of Rio de Janeiro sentenced this Tuesday (17) the country singer Eduardo Costa to pay compensation in the amount of R$70,000 for moral damage to presenter Fernanda Lima.

In November 2018, after the broadcast of the program “Amor e Sexo”, hosted by Fernanda, Eduardo Costa insulted the presenter on his social networks, saying that she was an “idiot” and only made shows for “stoners, criminals, leftists defeated, and for projects by artists like her.” The message also called on Brazilians to “sabotage Fernanda’s program.”

“This is an action by which the plaintiff seeks compensation for the offensive, defamatory and angry allegations allegedly made by the defendant in a post on Instagram. In view of the foregoing, I consider the plaintiff’s applications to order the defendant to pay the amount R$70,000plus default interest of 1% per month from the damaging event (comment on social network),” the judge wrote in the ruling.

Eduardo Costa was also ordered to pay the costs and fees of the case, which were determined in the arbitration at 20% of the value of the judgment, i.e. an additional R$14,000.

The conviction in civil proceedings takes place in the first instance and There is still an appeal.

Convicted of criminal acts

The singer is also the target of a criminal lawsuit filed by the actress, in which he has already been sentenced to eight months in prison and a 26day fine for defamation (with one day’s fine being equivalent to minimum wage).

Because the punishment was light, the singer benefited from the private punishment being replaced by the provision of community service.
