With its lawsuit against Custio Clayton in 2021, Eye of the Tiger sought a judgment for failure to honor the exclusive endorsement agreement agreed to in 2017 and for the loss of income resulting from the athlete’s refusal to follow through on a three-fight deal negotiated in his favor. If he won the first two fights, this agreement would have allowed Custio Clayton to take part in a lucrative world championship fight against current welterweight champion Terence Crawford.
After investing in Custio Clayton’s career, his about-face deprived Eye of the Tiger of the opportunity to see a return on its investment. Therefore, after analyzing the evidence, the Supreme Court concluded that Eye of the Tiger had fully established the merits of its claim against Custio Clayton and ordered him to pay the amount of $193,293.86 (plus interest and fees) to Eye of the Tiger.
“I am pleased with the outcome of this process and we will always do whatever is necessary to protect our team and our rights,” said Camille Estephan, President of Eye of the Tiger.
In addition, the Montreal promoter’s lawyer, Me Anthony Rudman, confirms that the ruling grants Eye of the Tiger’s requests.
“The verdict given is satisfactory. It recognizes the validity of the advertising agreement between Eye of the Tiger and Custio Clayton and reminds that there are consequences if either party does not comply with it.
