Danilo Gentili, 43, won a lawsuit for damages brought by 27yearold Nikolas Ferreira (PL). The federal lawmaker demanded compensation of R$44,000 and claimed to be the target of “defamatory, defamatory and hurtful statements”.
Splash had access to Nikolas’ appeal, which was denied by the judiciary today. Mateus Bicalho de Melo Chavinho, the judge hearing the case, did not consider a post by Danilo in 2021 to constitute moral damage.
“The applicant’s position in seeking damages for actions which he himself habitually commits is contradictory,” reads an excerpt from the decision.
Maurício Bunazar, Danilo Gentili’s lawyer, commented on the decision. “Fortunately, a victory for a citizen’s freedom of expression against a politician,” he said in contact syringes.
Danilo Gentili celebrated in a post on Twitter. “Fuck off, Nikolas Ferreira […] This is the guy who later seems outraged by leftwing censorship. He’s the guy who says that Bolsonarism defended freedom of speech. Sued me for making fun of him and losing again.
The crimes were mutual, the decision said. “Following the crime committed by the defendant, the plaintiff published in response a post in which he referred to the defendant (Danilo Gentili) as an ‘animal,’ an equally offensive term,” argues the lawsuit, citing another Nikolas publication.
