For the former president, the judge in the case should have conducted a “Google consultation” before questioning Chico Buarque’s composition
ExPresident Dilma Rousseff (PT) installed Your Twitter profile this Saturday (Dec. 3, 2020) to criticize the decision of Deputy Judge Mônica Ribeiro Teixeira of the 6th Special Civil Court of the Judicial District of the capital Lagoa do Rio de Janeiro, who questioned the authorship of the song “Roda Viva” in a lawsuit of the singer Chico Buarque against the federal deputy Eduardo Bolsonaro (PLSP).
“What is the basis of the judge’s ruling that concluded that there is no evidence that the song ‘Roda Viva’ was written by our great composer, musician and poet Chico Buarque de Holanda? Are you ignoring the abuse that Eduardo Bolsonaro made of the song?” Dilma asked.
The problem came to light after the composer filed a lawsuit demanding that the son of President Jair Bolsonaro (PL) delete a post on social networks in which he reproduced the song without his permission, and also seek compensation for nonmaterial damages in the amount of R$ 48,000.00. Here’s the whole action (524 KB).
Assessing the application, Deputy Judge Mônica Ribeiro Teixeira claimed that “a suitable document proving the applicant’s copyright in the song” was missing and denied the composer’s application (23 KB).
In the lawsuit, Chico Buarque’s defense claimed that the “composition of the work and recording of the music by Chico Buarque” is a “public and wellknown fact” and therefore concrete evidence is irrelevant.
For Dilma, the authorship of the song “could have been quickly remedied” by the judge in the case “with a request to Google” and to ECAD (Central Office of Collection and Distribution). According to the former president, this would reveal “what the whole country already knows”.
“Or is it sheer ignorance that one of the most beautiful songs in MPB history was written by Chico Buarque in 1967, sung by him at a festival, awarded 1st place and moving a whole generation of Brazilian men and women?” asked the former president.
The Petista was still releasing a video of the performance of Chico Buarque and the MPB4 group at the 3rd Festival of Brazilian Popular Music by Record in 1967, 3 years after the establishment of the military dictatorship in the country.
“See the evidence below that the music that enchanted Brazil and remains fundamental to this day was penned by one of the greatest composers of all time: Chico Buarque, who sang Roda Viva at the Song Festival when his victory was announced in 1967,” released.
