Elon Musk's X Loses Bid to Change California's Content Moderation Law – Deadline

X sued California in September to overturn the state's content moderation law, saying it violated the right to free speech under the First Amendment of the U.S. Constitution and the California state constitution.

Today, U.S. District Judge William Shubb dismissed the social media company's motion in an eight-page decision.

The law requires major social media companies to publish semi-annual reports detailing their content moderation practices. You must also provide data about the number of offensive posts and how they were addressed.

“While the reporting requirement imposes a significant compliance burden on social media companies, it does not appear that the requirement is unwarranted or unduly burdensome in the context of First Amendment law,” Shubb wrote.

X didn't respond immediately. The company's content moderation policies have long been controversial, dating back to before Musk bought the company.

The case is X Corp v. Bonta, U.S. District Court, Eastern District of California, No. 2:23-cv–01939.
