The defense's appeal against the seizures ordered by the Turin prosecutor's office as part of the investigation into Gianni Agnelli's inheritance was partially upheld.
According to initial information, the appeal court also ordered the return of some of the documents obtained by the financial police to interested parties. The appeal was brought by lawyers for John Elkann and accountant Gianluca Ferrero.
The investigation by the Turin Public Prosecutor's Office was launched on the hypothesis of the crime of false declaration of income related to the tax treatment that Marella Caracciolo, wife of Gianni Agnelli, received from her daughter Margherita for the years 2018 and 2019, as part of the succession agreements made in 2004 . The defense argued that the amount of material seized by the financial police was disproportionate to the crime hypothesis. The court partially revoked the search warrant drawn up by the public prosecutor. From reading the file, it appears that the judges have maintained the seizure of some documents related to the property of Marella Caracciolo (died February 23, 2019 at the age of 92).
