The Court of Justice of the European Union has ruled that Meta must obtain user consent in order to display personalized advertising.
What do we know.
According to the judgement, such ads do not justify the processing of large amounts of data without the consent of the user. The court also fined Meta €390 million for forcing Facebook, Instagram and WhatsApp users to accept personalized ads.
The EU requires consent to use features to be “voluntary”. The court also ruled that Meta violated the General Data Protection Regulation (GDPR) by requesting data for targeted advertising on basic Facebook, Instagram and WhatsApp usage.
In the new judgment, the Court of Justice of the European Union said that it is up to the website operator to prove that people are giving their consent voluntarily.
