Federal prosecutors are considering four charges against Hunter Biden, three related to tax crimes and one charge of a felony related to a gun purchase, according to a new report Friday.

The possible charges include two counts of failure to file taxes, a single count of tax evasion related to business expenses for a tax year, and the gun charge, also a potential felony, NBC News reported, citing sources.

Upon purchasing a .38 caliber gun in 2018, Hunter wrote in the Firearm Transaction Record that he was not using any illegal drugs, but admitted in his memoir that he was addicted to crack at the time. Deliberately providing misleading information when purchasing a gun is a criminal offense.

In addition, two senior law enforcement agencies told the network that there was “growing frustration” within the FBI because most of the investigative work was completed over the past year, while the IRS completed its tax investigation more than a year ago.

But the decision on what charges to file against President Joe Biden’s son — and when — rests in the hands of US Attorney David Weiss, appointed by President Donald Trump and tasked by the Biden administration to continue the investigation.

There is no indication of when charges might be brought. Hunter Biden has denied any wrongdoing.

The Hunter Biden investigation began in 2018 during the Trump presidency. The former president used Hunter Biden as a rallying cry for his base in his unsuccessful 2020 re-election campaign.

The first investigation focused on Hunter Biden’s finances related to his overseas operations.

Over time, it focused on whether or not he had declared all of his income and whether he had lied about gun purchase records in 2018.

House Republicans are also investigating Hunter Biden and his dealings.

And earlier this week, a man serving as a supervisory agent in a “high-profile” criminal tax investigation came forward, asking for whistleblower protection while claiming the policy was “unduly infecting decisions” in a particular investigation.

This covert question was believed to pertain to the Hunter Biden case.

An attorney representing the unidentified whistleblower wrote to senators and inspectors general from the Justice Department and Treasury Department on Wednesday.

The proprietary disclosures “contradict an affidavit by a senior political official before Congress” and “include a failure to mitigate clear conflicts of interest in the final determination of the case,” according to attorney Mark Lytle of Nixon Peabody.

They “also describe preferential treatment and policies that unduly infect decisions and protocols that would normally be followed by career law enforcement officials in similar circumstances if the issue were not politically related,” Lytle wrote in a letter obtained by .
