German court annuls 2021 elections in Berlin, overshadowed by irregularities

O Berlin Constitutional Court canceled this Wednesday (16th) the local elections of September 2021 in the German capital, in which several failures were recorded. This unprecedented situation will lead to the holding of new elections.


“The elections in the House of Representatives and in the district assemblies will be declared invalid in the entire electoral area,” announced Court President Ludgera Selting.


Court officials cited the “frequency and severity of electoral errors” to justify this decision, which was unusual in recent German history. Accordingly, the errors are related to “systematic errors in the preparation of the elections”.




New elections with the same candidates are to be prepared in the next 90 days, probably on February 12.


The city is currently led by former Minister Franziska Giffey (SPD), at the head of a coalition of environmentalists and the extreme left.


Berlin voters were called to the ballot box on September 26 to elect members of the Bundestag, members of the House of Representatives and the assemblies of the city’s 12 districts. A referendum on the possible expropriation of large real estate groups was also carried out.


However, on Sunday, September 26, Berlin was partially paralyzed for a marathon that normally brings together thousands of participants. Many voters complained that they were unable to vote or had to wait hours because of the unrest.


The various votes were also hampered by the presence of incorrect or inadequate ballot papers and the small number of ballot boxes.
