The retired optometrist, who took actress Gwyneth Paltrow to court over a skiing collision in 2016, has claimed he can no longer enjoy wine tasting due to injuries sustained in the collision.

The Hollywood star and Goop CEO was accused of colliding with Terry Sanderson, 76, on a ski slope at Deer Valley Resort in Park City, Utah, in February 2016.

Mr Sanderson alleges Paltrow ran into him in a “full-body punch” and left behind “permanent traumatic brain injuries, four broken ribs, pain, suffering, loss of zest for life, emotional distress and disfigurement”.

Meanwhile, Paltrow claims it was Ms. Sanderson who bumped into her.

Neuroradiology expert Dr. Windell Gibby testified Wednesday that the collision caused his quality of life to “suddenly” decrease sharply and he was no longer able to enjoy his pastimes.

“Terry was a high-functioning, active person…meeting with groups, wine tasting, skiing, volunteering,” she said.

“After the accident, his condition took a sudden turn for the worse and he stopped many of the activities he enjoyed doing.”

Mr. Sanderson is seeking $300,000 from Paltrow while she is seeking $1 in damages and coverage for her attorneys’ fees.

Gwyneth Paltrow has appeared in a US court to stand trial in a case in which the 2016 Oscar winner allegedly collided with skier Terry Sanderson at Utah’s Deer Valley Resort, rendering him unresponsive.

Attorneys for Paltrow and Mr Sanderson, who is suing her, made their opening statements in court on Tuesday.

Lawyers for Mr Sanderson said they plan to call Paltrow to the witness stand on Friday but could do so earlier in the week depending on the availability of the other witnesses, the Associated Press reported.

Paltrow’s husband Brad Falchuk and their two children, 18-year-old Apple and 16-year-old Moses, are also expected to testify.

The actor’s attorney, Stephen Owens, described the members of Paltrow’s family as part of their skiing group when the incident happened on February 26, 2016.

“You, Brad, now your husband you will hear from, your daughter Apple you will hear from, Moses you will hear from,” he was quoted as saying by People magazine.

Who is Terry Sanderson?

The incident happened on February 26, 2016 on the slopes of Flagstaff Mountain, part of the Deer Valley Resort near Park City, Utah, when Paltrow and retired optometrist Dr. Terry Sanderson collided at a beginner’s class known as the Bandana Run.

Mr. Sanderson, 76, subsequently filed damages in January 2019, seeking $300,000 in damages for the injuries sustained, prompting Paltrow to file a counterclaim, seeking a token $1 in the event of her winning and asks for their legal costs to be covered.

Gwyneth complains about being photographed at a ski collision trial

Before the second day of trial began on Wednesday, the Goop founder’s lawyers argued that her privacy was invaded by a courtroom camera pointed directly at her face and paparazzi waiting for her in the parking lot.

“We put a new camera on my client right there,” attorney Steve Owens said. “That was a [continuing] Problem, for example, reporters stood in front of my client’s car yesterday and had cameras in her face.”

He continued, “I’m pissed, I don’t want reporters making changes without letting them know [the judge].”

Terry Sanderson heard “hysterical screaming” before the collision.

Mr Sanderson claims Ms Paltrow descended the beginner’s slope of the Bandana Run on Flagstaff Mountain “out of control”, according to Court TV.

He claims she hit him so hard that he passed out. At a press conference in 2019, he said that just before the collision, he “heard this just hysterical screaming like … King Kong in the jungle or something.”

He said at the time that he thought the speed at which Ms Paltrow allegedly approached him might explain the extent of his injuries. “A little little bullet can make a big hole,” he said, according to The Salt Lake Tribune.

At that press conference announcing the lawsuit, Mr Sanderson said he noticed a series of large “slow down” signs as he went down the Bandana slope, so he slowed down but still stayed with the flow of other skiers who were came down the slope.

“It was just instantaneous,” he said in 2019. “I got hit in my back. … It felt like it just propelled me.”

He said he remembered not being able to control himself as he went down.

“And that’s all I remember up to this point — just get out,” he said.

Expert explains Mr Sanderson’s injuries after the collision

Mr. Sanderson’s attorneys are trying to prove that it was Ms. Paltrow who rammed her client, arguing that the downhill skier always has the right-of-way.

Instead, Ms Paltrow argues that Mr Sanderson rammed her.

Neuroradiology expert Dr. Gibby testified for the defense that the scenario presented by Mr Sanderson’s lawyers was more consistent with the level of injuries he sustained – four dislocated fractured ribs.

“The level of injury from simply falling over would not be the same as if someone hit you and knocked you over,” said Dr. Gibby. “If you have the combined strength of two people, that would also…increase his likelihood of injury.”

ICYMI: The parties want to prove who is to blame for the collision

Mr Sanderson argues that Ms Paltrow is essentially at fault for the accident. In his 2019 complaint, he alleges that after the collision, she “got up, turned and drove away, leaving Sanderson stunned in the snow and badly injured.”

“A Deer Valley ski instructor who had coached Ms. Paltrow but did not see the fall skied over, saw the injured Sanderson and skied away, falsely accusing Sanderson of causing the fall,” the complaint reads .

Ms. Paltrow, on the other hand, claims her instructor actually witnessed the collision.

The rule of hills in Utah is that those in front of you have the right of way and those coming from behind must give way to others. Both Mr. Sanderson and Ms. Paltrow claim they were further down the mountain.
