Italy accuses ChatGPT of violating data protection regulations

As we learned on Tuesday, the Italian Personal Data Protection Authority has asked OpenAI, the company that owns the artificial intelligence program ChatGPT, to comply with the rules in force in the European Union.

According to a press release, the Italian authority considers that the provisions followed by OpenAI to protect the personal data of its users constitute “irregularities” compared to the EU General Data Protection Regulation (GDPR).

OpenAI now has 30 days to respond to the authority, which says its decision will take into account “ongoing work” within the working group set up by the EU to promote cooperation in this area.

The Italian authority blocked ChatGPT at the end of March 2023, accusing it of not complying with European regulations and having no system to verify the age of underage users.

The authority also criticized ChatGPT for “the lack of an information notice for users whose data is collected by OpenAI (…) with the aim of training the algorithms that operate the platform.”

At the end of April of the same year, the program on the peninsula was re-approved, with the Italian authority acknowledging “the progress made to combine technical progress with respect for people’s rights”.
